April 10th, 2923
The Kemmerer City Council met in regular session this 10th day of April, 2023, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor William Thek, Councilmember Robert Bowen, Councilmember Dale Hicks, Councilmember Bill Price, and Councilmember Jamie Thornock. Councilmember Marlin Batista and Councilmember Mark Quinn were absent.
Motion was made by Councilmember Hicks to excuse the absence of Councilmember Batista and Councilmember Quinn; seconded by Councilmember Price and unanimously approved by council present.
Motion was made by Councilmember Hicks to approve the agenda as amended to add New Business (b), Appointment to the Zoning Board; seconded by Councilmember Price and unanimously approved by council present.

(b) Motion was made by Councilmember Hicks to pass on 2nd Reading Ordinance No. 2023 876, Amending Section 20-6(s), Design Standards for Open Spaces and Section 23 106(d), Requirements for Standards for Open Spaces; seconded by Councilmember Bowen and unanimously approved by council present.
NEW BUSINESS:
(a) Motion was made by Councilmember Bowen to Pass, Approve and Adopt Resolution No. 2023 815, Dissolving the Recreation Advisory Board for the City of Kemmerer; seconded by Councilmember Thornock. The mayor then called for the question. Those voting “Yea” were Councilmember Bowen and Councilmember Thornock. Those voting “Nay” were Councilmember Hicks and Councilmember Price. The Mayor broke the tie with a “Yea” vote. Motion carried.
(b Motion was made by Councilmember Price to appoint Barb Peavler to the Kemmerer Zoning Board for a term to expire on 12/31/2024; seconded by Councilmember Hicks an unanimously approved by council present.

ADVERTISEMENT FOR BIDS
Separate sealed BIDS, on our forms, for the purchase of a new or used garbage truck with installed packer body for the City of Kemmerer will be received by the City of Kemmerer at the City Hall, 220 Wyoming Highway 233, Kemmerer, Wyoming until 2 p.m. local time Thursday June 8, 2023, at which time and place said bids will be publicly opened and read aloud.
Bid packets and specifications can be received from the City of Kemmerer, 220 Wyoming Highway 233, Kemmerer, Wyoming, 83101 or the city website at www.kemmerer.org.
Preference is hereby given to materials, supplies, equipment, machinery and provisions produced, manufactured, supplied to, or grown in Wyoming, quality being equal to articles offered by the competitors outside of state.
All bids must be accompanied by either a certified check, cashier’s check drawn on an acceptable bank, or an acceptable BID BOND, executed by an approved Surety Company, in an amount no less than five percent (5%) of the total sum of the bid. The check or bond shall be made payable to the City of Kemmerer and will be retained by the City as liquidated damages if the successful bidder refuses or fails to enter into a contract and bond in accord with his bid when notified of the award.
If, at the time the bid is to be awarded, the OWNER determines that the amount of funds available is sufficient to finance the equipment, the bid may be awarded to the lowest responsible BIDDER. Determination of the lowest responsible BIDDER shall take into account all applicable provisions of Wyoming Statutes 2022, as amended.
The bid shall be let to the responsible certified resident bidder (as defined by Wyoming Statutes) making the lowest bid if the certified resident’s bid is not more than five percent (5%) higher than that of the lowest responsible non-resident bidder.
The bidder to whom the bid is awarded will be required to give to the City of Kemmerer a performance bond in the penal sum equal to the total amount of his bid, with a surety for the faithful performance of his contract. The surety shall be a resident of the State of Wyoming, who owns property in the state amounting in the aggregate to double the amount of the bond upon which it becomes a surety. Any surety or guaranty company, duly qualified to act as surety or guarantor in the State of Wyoming upon executing individual bond, shall be accepted in lieu of such surety.
The City of Kemmerer reserves the right to reject any and all bids, to waive irregularities in the bids and to accept any bid or bids deemed to be in the best interest of the City of Kemmerer. Bids must be original, signed, sealed bids on our forms. Faxed bids will not be accepted.
Bids may not be withdrawn after the time fixed for opening them.

Motion was made by Councilmember Bowen to approve the 100% fee waiver for the K Town Boomer’s Corn Hole Tournament at the SLTEC on May 20 and 21, 2023; seconded by Councilmember Hicks and unanimously approved by council.
(b) Motion was made by Councilmember Hicks to keep the 4th of July reserve monies with the city and communicate with K-Town Boomers that there is $5,106.34 available to pay the fireworks vendor once the invoice is presented to the city; seconded by Councilmember Price and unanimously approved by council.
(c) Motion was made by Councilmember Hicks to approve the transfer of the property at 105 JC Penney Drive from the City of Kemmerer to the Kemmerer Senior Center provided that the Kemmerer Senior Center covers up to $1,500.00 in transaction costs; seconded by Councilmember Price an unanimously approved by council.
(d) Motion was made by Councilmember Hicks to rescind the November 28, 2022, purchase and sale of 809 & 823 South Main Street with Rain Fire LLC; seconded by Councilmember Batista and unanimously approved by council.
(e) Motion was made by Councilmember Hicks to rescind the November 28, 2022, purchase and sale of 823 Pine Avenue with Rain Fire LLC; seconded by Councilmember Bowen and unanimously approved by council.

OF BLASTING SCHEDULE
Pursuant to Public Law 95-87, Section 515 (b)(15)(A) of the Surface Mining Control and Reclamation Act of 1977, and the Wyoming Environmental Quality Act, Statute 35-11-415, Duties of operator, and in accordance with the regulations authorized and promulgated thereunder, Kemmerer Operations, LLC hereby presents notice of blasting operations to be conducted at the Kemmerer Mine. The specific locations are:
1-UD Complex, a portion of Tracts 91, 95, 97, 98C, 98B, 99, 100, 101,102 and 103, T21N, R116W, the active pit area containing 100 acres, more or less, and all located within Lincoln County, WY.
Pit 2-UD, a portion of Sec. 15, and a portion of Section 22, T20N, R117W, the active pit areas containing 50 acres, more or less, and all located within Lincoln County, WY.
I-Area Pit, a portion of or all of Lots 9 and 10 in section 30 and Tracts 85, 86, 87 and 88, T21N R116W, the active pit areas containing 150 acres, more or less, and all within Lincoln County, WY.
Blasting may be necessary on the above described locations of Kemmerer Operations, LLC’s Kemmerer Mine in order to maintain scheduled mining operations on the following dates in 2023 & 2024:

All clear signal - Maintained Peak Tone - One Minute
All blasting will be conducted according to the above dates and schedules unless an emergency situation arises which indicates the need for an unscheduled detonation of blasting materials. These emergency situations may be as follows:
1. Rain
2. Lightning
3. Adverse Atmospheric conditions
4. Any other unforeseen circumstances which may jeopardize the safety of persons, (operators or public) that may be in the vicinity of the mine site.
Should alterations to the above schedule be necessary, with exception given to emergency situations, further public notice will be advertised accordingly.

The Court shall, on or after May 26, 2023, consider the Application. Notice is given that if it appears to the Court that the facts stated in the Application are not in dispute, the Court shall enter a decree establishing the right and title to the mineral interests.

This notice is submitted to alert all families of children who attended a Lincoln Uinta Child Development Association developmental disabilities preschool program during the school year 2015 through 2016. If your child received services through one of LUCDA’s centers (Alpine Child Development Center, Bridger Valley Child Development Center, LUCDA-Evanston, Kemmerer Child Development Center, Star Valley Child Development Center (Afton or Thayne) during the years listed, those records will be destroyed on or after June 1, 2023. If parents wish to obtain their child’s records they may contact the local center where their child attended or the LUCDA Regional Office at P.O. Box 570, Mountain View, WY 82939, (307) 782-6602 prior to June 1, 2023. Records will be given only to those who can prove guardianship of the child. If you are a friend or relative of a child who attended the program during these years, please assist the program by notifying parents that records are available.
