The Wyoming Public Service Commission (Commission) approved the Application of Questar Gas Company, d/b/a Dominion Energy Wyoming (Dominion or the Company) to amortize the Conservation Enabling Tariff Balancing Account resulting in a rate increase to $0.02612 per dekatherm (Dth), for all General Service class customers, effective for usage on and after January 1, 2024.

The proposed change is based on the amortization of an over collected balance of $89,058.49 as of October 2023, and on a 12-month test year ending December 31, 2024. The Company’s proposal results in an annual increase of approximately $11.96 or 1.10% before taxes, for a typical residential customer using 80 Dth.

February 16, 2024

The Kemmerer City Council met in regular session this 26th day of February, 2024, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor William Thek, Councilmember Marlin Batista, Councilmember Robert Bowen, Councilmember Dale Hicks, Councilmember Bill Price, and Councilmember Jamie Thornock (via telecon). Councilmember Mark Quinn was absent.

Motion was made by Councilmember Hicks to excuse the absence of Councilmember Quinn; seconded by Councilmember Price and unanimously approved by council present.

Motion was made by Councilmember Hicks to approve the agenda as presented; seconded by Councilmember Bowen and unanimously approved by council present.

(a) Motion was made by Councilmember Bowen to Pass on 2nd reading Ordinance No. 2024 884, Completely Adopting the International Building Code (IBC) in Chapter 7 Section 15 of the Building Regulations Ordinance and Rescind anu Exceptions to the IBC in such code and adding language to Chapter 7 Section 7-16b and Deleting Chapters R313 and P2904 Requiring Fire Sprinklers in One and Two-Family Dwellings and Town Homes and other exemptions as stated; seconded by Councilmember Hicks and unanimously approved by council present.

NEW BUSINESS:

Robert Bowen recused himself from the meeting; 7:30 p.m.

(a) Motion was made by Councilmember Hicks to appoint Jennifer Edinger as the at-large member to the Fossil Basin Promotion Board for a term to expire on 12/31/2024; seconded by Councilmember Price and unanimously approved by council present.

Robert Bowen reentered the meeting; 7:30 p.m.

(b) Motion was made by Councilmember Hicks to commit to using Rugged Mountain Aviation as the city’s aerial mosquito spray applicator and authorize mayor to sign a letter addressed to Rugged Mountain Aviation indicating the city’s commitment; seconded by Councilmember Bowen and unanimously approved by council present.

(c) Motion was made by Councilmember Hicks to authorize the mayor to sign a letter to the FAA approving J-U-B’s Engineering Fee Proposal for the Design and Bidding Phase of the Rehab Lighting on the Runway/Taxiway and Replacing Windcone Project at the airport; seconded by Councilmember Batista and unanimously approved by council present.

(d) Motion was made by Councilmember Price to authorize the mayor to sign the agreement for professional services with J-U-B for the Design and Bidding Phase of the Rehab Lighting on the Runway/Taxiway and Replacing Windcone Project at the airport in an amount not to exceed $118,720.00, seconded by Councilmember Hicks and unanimously approved by council present.

(e) Motion was made by Councilmember Hicks to authorize staff to send a letter to WYDOT showing intent of participating in the WYDOT salt and sand collaboration for FY 24-25 in an amount not to exceed $60,000; seconded by Councilmember Bowen and unanimously approved by council present.

(f) Motion was made by Councilmember Hicks to waive past and future fees through June 30, 2024 for hauling refuse to the landfill related to the cleanup project of the Hams Fork Museum in exchange for the museum acknowledging the City as a sponsor; seconded by Councilmember Batista and unanimously approved by council present.

(g) Motion was made by Councilmember Hicks to Pass, Approve and Adopt Resolution No. 2024 830, Amending Fossil Island Golf Advisory Board Bylaws; seconded by Councilmember Bowen and unanimously approved by council present.

Mary Crosby made comments to the council.

(h) Motion was made by Councilmember Hicks to authorize the mayor to sign a letter authorizing city staff to apply to the Intermountain West Nuclear Energy Corridor (INEC) Tech Hub Phase II EDA Grant in an amount of $1,380,000.00; seconded by Councilmember Bowen. The mayor called for the questions. Those voting “Yea” were Councilmember Batista, Councilmember Bowen, Councilmember Hicks, and Councilmember Price. Councilmember Thornock voted “Nay.” Motion carried.

COMMENTS:

City Administrator, Brian Muir, made comments. Councilmember Batista, Councilmember Hicks, Councilmember Price, Councilmember Bowen, and Councilmember Thornock made comments. Mayor Thek made comments.

AN ORDINANCE RESCINDING ANY EXCEPTIONS TO THE INTERNATIONAL BUILDING CODE IN CHAPTER 7 SECTION 15 OF THE BUILDING REGULATIONS ORDINANCE AND DELETING CHAPTERS OF THE INTERNATIONAL CODE REQUIRING FIRE SPRINKLERS ON RESIDENTIAL ONE AND TWO FAMILY RESIDENTIAL DWELLINGS AND TOWN HOMES AND CENTRALIZE ALL IRC CODE EXEMPTIONS IN 7 17.

BE IT ORDAINED by the Governing Body of the City of Kemmerer, Lincoln County, Wyoming, that Chapter 7 Section 15 of the Building Regulations Ordinance And Deleting Chapters of the International Code Requiring Fire Sprinklers on Residential One and Two Family Residential Dwellings And Town Homes and Centralize all IRC Code Exemptions in 7-17 is Hereby Amended As Follows:

DIVISION I.  COMMERCIAL BUILDING CODE

SECTION 7-15. PERMIT EXCEPTIONS – RESERVED

DIVISION II .  INTERNATIONAL RESIDENTIAL CODE ADOPTED; AMENDMENTS.

SECTION 7-16.  INTERNATIONAL RESIDENTIAL CODE ADOPTED

(b) The following sections of the current edition of the International Residential Code are amended, deleted or added as follows:

(10) Chapter R313 requiring fire sprinklers in detached 1- and 2- family dwellings and town houses not more than 3 stories above grade with separate means of egress, and their accessory structures not more than three stories in height is deleted.

(11) Chapter P2904 describing installation requirements of fire sprinklers is deleted.

SECTION 7-17.  PERMIT EXCEPTIONS

(a) Other than storm shelters, one-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 200 square feet.

(h) Sidewalks and driveways not more than 30 inches above adjacent grade, and not over any basement or story below are not part of an accessible route.

(i) Shade cloth structures constructed for nursery or agricultural purposes, not including services systems.

(j) Nonfixed and movable fixtures, cases, racks, counters and partitions not over 5 feet 9 inches in height.

(k) Decks not exceeding 200 square feet in area, that are not more than 30 inches above grade at any point, are not attached to a dwelling and do not serve the exit door required by Section R3111.4 of the International Residential Code.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for approval to adjust Category 1, 2, and 3 Demand Side Management (DSM) Surcharge Rates in electric service Schedule 191, the Customer Efficiency Service Charge, effective April 1, 2024.

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.

2. On February 2, 2024, RMP filed an Application requesting the Commission approve its proposed adjustment to Category 1, 2, and 3 DSM surcharge rates in tariff Schedule 191. The Company stated, in the Application, the adjustment is to align with the 2024-2026 DSM plan approved by the Commission in Docket No. 20000-632-ET-23, and to comply with the 2023 Order issued with that docket in which the Company is to file updated rates intended to recover costs associated with the approved offerings.

3. RMP submitted exhibits reflecting over and under collected balancing account amounts, actual balancing account results through November 2023, and forecasted results through December 2026 using current Category 1 and 2 rates in tariff Schedule 191. Category 1 is estimated to be over collected by $872,943 and Category 2 is estimated to be under collected by $270,247.

4. To address the over and under collected balances, the Company proposed revisions to Schedule 191 decreasing Category 1 and increasing Category 2 rates to 2.33 percent and 2.27 percent, respectively, effective April 1, 2024. RMP also proposed to decrease rates for Category 3 customers to 1.03 percent, 1.12 percent, and 1.21 percent in compliance with the 2023 Order. The revised rates for Category 3 customers will be effective April 1, 2024, and then January 1st of each following year of the 3-year DSM plan.

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part there-of, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage on the date of first publication of this notice of sale being the total sum of $80,018.60 which sum consists of the unpaid principal balance of $71,524.92 plus Interest accrued to the date of the first publication of this notice in the amount of $4,708.03, plus attorneys’ fees, costs expended, and accruing interest and late charges after the date of first publication of this notice of sale;
