A RESOLUTION CHANGING THE TIME FOR CITY COUNCIL WORK SESSION AND REGULAR SESSION MEETINGS
WHEREAS, the City of Kemmerer has been holding its City Council Pre-Meeting Workshop at 6:00 pm and its Regular Meeting at 7:00 pm; and
WHEREAS, having meetings earlier may benefit many citizens who wish to attend and listen and participate in the Regular meeting; and
WHEREAS, the City of Kemmerer Mayor and Council and City Staff are available for an earlier schedule, which could get them home earlier to get rest for work the next day and provide for more productive meetings;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Kemmerer, Lincoln County, Wyoming, The Kemmerer City Council Pre-Meeting Workshop shall begin at 5:00 p.m. and the Regular Meeting shall begin at 6:00 pm, effective May 27, 2025.

AN ORDINANCE AMENDING SECTION 23-46 CN – COMMERCIAL NEIGHBORHOOD DISTRICT, OF THE KEMMERER CITY CODE
BE IT ORDAINED by the Governing Body of the City of Kemmerer, Lincoln County, Wyoming, that Section 23-46 of the Kemmerer City Code is hereby amended as follows:
SECTION 23-46. CN – COMMERCIAL NEIGHBORHOOD DISTRICT
Purpose:
Intended to provide small commercial area that cater to the daily convenience shopping and service needs of the surrounding residential neighborhood. The scale and design of buildings within this district must be compatible with the neighboring residential uses. A condominium method of ownership as specified in Chapter 29 of this code and in conformance with the uses allowed in this section.
Permitted Uses:
Veterinary hospital
Filling stations
Restaurant over 3,000 square feet or drive-thru
Studios for music, dancing, and art lessons
Publicly owned and operated facilities
Medical treatment facility

AN ORDINANCE AMENDING ARTICLE III, WEEDS, AND ARTICLE IV, CHARGES OF CHAPTER 16 OF THE KEMMERER CITY CODE
BE IT ORDAINED by the Governing Body of the City of Kemmerer, Lincoln County, Wyoming, that Article III and Article IV of Chapter 16 of the Kemmerer City Code is hereby amended as follows:

ARTICLE IV. CHARGES
(a) A new utility user, upon application for sanitation service, shall pay in advance a deposit. Such deposit amount shall be set by the city council, from time to time, by resolution.
(b) At the end of one (1) year, at the request of the utility user or the city treasurer, the deposit will be applied to the active utility account. Upon voluntary discontinuation of service, at the request of the utility user or the city treasurer, the deposit will be refunded, provided all utility charges are paid in full.
(c) Should the user become sixty (60) days or more delinquent in payment of sanitation charges, this deposit may be applied to such delinquency.
SECTION 16 23. BILLS, NOTICES, ETC., EFFECTIVE UPON MAILING.
Billing for sanitation service, and any other notices relating to the sanitation utility, shall be effective upon mailing such billing or notice to the address of the utility user as shown on the records of the city clerk/treasurer’s office.
SECTION 16 24. WHERE PAYABLE; DUE DATE; DELINQUENCY.
(a) Due Date: All charges for sanitation service as provided in this Article are due and payable at the office of the city treasurer. All charges are due and payable on or before the 15th of the month following the billing.
(b) Delinquent: Payment is delinquent by the close of the 15th day of the month following the due date.
(c) Penalty Charged: The balance of any bill due and payable the 15th of the month following the billing that is not paid within 30 days of the due date shall be subject to monthly late charge in a sum as the City Council may set, from time to time, by resolution.
(d) Delinquent List: Accounts that have become delinquent will be placed on a list and delinquent notices mailed on the 16th of each month or the first working day following the 16th of the month via US mail.
(1) Notices shall state that the account is past due.
(2) Notices shall state the time and date that payment in full (payment of past due and penalty charges) is due to avoid loss of service.
(3) Notices will include in the amount due the penalty charge.
(e) If a utility user shall fail to pay all sanitation charges within thirty (30) days of the due date, the utility user will be notified by mail that the user's account is past due and if payment of all utility and late charges in full is not received within seven (7) calendar days, utility user may have their service interrupted or legal action will be taken by filing with small claims court for collection for any amounts due plus fees.
(f) If a utility user shall fail to pay all sanitation charges by the date specified on the delinquent notice, the utility user’s sanitation can or container will be removed from the premises the Monday following the delinquent date.
(1) Utility users will receive a hand delivered removal notice that states that the can has been removed from the premises due to a delinquent account balance.
(2) If a can is removed from a premises for delinquency the utility user will be required to pay past due charges, penalty charges, and a $30.00 delivery fee to have the can returned to the premises.
(3) If the City is unable to remove the can from the premises the utility user will continue to be billed for their sanitation service until such time that the can is able to be removed from the premises.
(g) In addition to utility and penalty charges, the utility user shall be responsible for all costs and expenses of collection, including reasonable attorney fees and costs as may be incurred, with or without suit.

Robert Cole Duerr defaulted on the terms of the Note and Mortgage, and as of the date of this Notice, the undersigned claims an outstanding balance of $283,401.73. Interest continues to accrue on the unpaid balance at the rate of $33.49 per day.

Kemmerer/Diamondville Joint Powers Board Nations Avenue Transmission Line Replacement
Separate sealed bids for construction for the Kemmerer/Diamondville Joint Powers Board Nations Ave Transmission Line Replacement Project will be received by the Kemmerer/Diamondville Joint Powers Board from bidders.
Bids will be publicly opened and read aloud at 3:00 PM on Tuesday, June 10, 2025 at 1004 Elk St, Kemmerer, WY, 83101.
The work to be performed under this project shall consist of furnishing all labor, materials and equipment required to construct the facilities and features called for by the CONTRACT DOCUMENTS and as shown on the DRAWINGS.
Installation of approximately 1300 LF of 16” Waterline. Disconnection, capping, and abandonment of the existing section of 16” waterline. Connection of the new line to the existing lines, reconnection of service connections, and fire hydrants, installation of valves, one casing, and roadway restoration in the construction area.
This project is funded by the Kemmerer/Diamondville Joint Powers Board and MRG Funds.
Plans and specifications have been prepared by Sunrise Engineering and will be available after Tuesday, May 20, 2025 on their website plan room at http://www.sunrise-eng.com. Click on “Plan Room” at the top of the homepage. Bidders must register and sign-in and choose to become a plan holder to obtain access to CONTRACT DOCUMENTS and DRAWINGS. Notices regarding changes/amendments to the CONTRACT DOCUMENTS and DRAWINGS will be sent to the e-mail address associated with the bidder’s registration. Bidders are responsible to maintain current and correct contact information and check the plan room often to receive updates or additional documents/changes/amendments. The ENGINEER for this Contract will be Sunrise Engineering, Incorporated and they will be represented by Kamilla Schultz, P.E. as Project Engineer.
A pre-bid tour will be held on Tuesday, June 3, 2025, at 3:00 p.m., leaving from the office of the Owner at 1004 Elk Street, Kemmerer, WY, 83101. Attendance at the pre-bid tour is requested. Names of those in attendance will be recorded.
The Contract shall be let to the responsible certified resident making the lowest bid, if the certified resident’s bid is not more than five percent (5%) higher than that of the lowest responsible nonresident bidder and the resident bidder does not propose to subcontract more than thirty percent (30%) of the work to nonresident contractors (Wyo. Stat. 16-6-101, et seq.). Resident for this purpose means a person, partnership, limited partnership, registered limited partnership, registered limited liability company or corporation certified as a resident by the Department of Employment prior to bidding upon the Contract and meeting the further criteria in W.S. 16-6-101, et seq. A resident bidder shall submit a copy of its certificate of residency with its bid.
Pursuant to W.S. 16-6-106, “Preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state.
Bid security in the form of a Bid Bond shall be furnished with the bid in the amount of 5% of the total bid.
Contract security in the form of a Performance Bond and Payment Bond shall be provided pursuant to W.S. 15-1-113(d) and 16-6-112. The contract security shall be 100% of the contract amount pursuant to W.S. 15-1-113 (d) and (f).
Final Payment will not be made until conditions and requirements of W.S. 16-6-116, 16-6-117, and 15-1-113(h) are met.
Retainage will be held on all progress payments in accordance with W.S. 16-6-702. Retainage will be Ten percent (5%) and may be held in a contractor designated interest bearing account for retainage in accordance with W.S. 16-6-702, -704 and -705.
