Chairman Kent Connelly called the regularly scheduled meeting to order at 10:00 a.m.
Others in attendance included the following: Commissioners Teri Bowers and Melvin Shumway; County Clerk, April Brunski; Deputy Attorney, Austin Dunlap; Chief of Staff, Stephen Allen.
The pledge of allegiance was recited, and the invocation was given by Commissioner Shumway.
Motion #1: Commissioner Bowers moved to approve the consent agenda, minutes from August 25, 2026, and approval of the vouchers. Seconded by Chairman Connelly. Motion carried unanimously.
Chief of Staff, Stephen Allen, presented years of service award for the following: Heather Sanchez – 5 years (Clerk/Treasurer’s Office); Jodie King - 10 years (Sheriff’s Office); David Hammond – 15 years (Sheriff’s Office); Judi Nield – 20 years (Attorney’s Office). He updated on the following events he recently participated in: Wyoming Miner’s Hospital Board meeting; PENEFra Sewer meeting; WWCC Foundation Meeting; JCP Days. He also updated on ongoing projects: SIRQ – notice of substantial completion ending September 14th; Industrial Siting – no new applications, Terra Power (pending completion 2031), Project West (We Soda 2027), Dry Creek Trona (Pacific Soda December 2026, Proposed December 2027), Dry Piney Helium (Blue Spruce 2026), Lincoln Star (2027); SLIB – October 1st;
NEPA – Monitoring comments on BLM and Forest Service; Rock Springs RMP (Cooperator) – comments submitted, awaiting approval to have public comment; Dept of Interior reopens Regulatory Reform Comment Period; Forest Service (Cooperator); Wild and Scenic list for public review by end of 2026. He presented the following correspondence for approval:
Motion #2: Commissioner Shumway moved to approve an agreement with SIRQ Construction for Architectural Drawings to retrofit the Historic District Courtroom for an amount not to exceed$30,000 and authorizing the Chair to sign the agreement. Seconded by Commissioner Bowers. Motion carried unanimously.
Chairman Connelly discussed a Beacon Replacement Grant Project for the Kemmerer Airport. This is through the Joint Powers Board Agreement. The County portion would be$1500. The Commissioners did not take any action.
Dain Schwab, County Coroner, discussed a request to add compensation at an hourly rate for Deputy Coroners for travel time for occasional trips to the pathologist in Colorado.
Motion #3: Commissioner Shumway moved to approve compensation of$22 per hour for Deputy Coroners for travel for autopsies. Seconded by Commissioner Bowers. Motion carried unanimously.
The Commissioners went over discussion items. Chairman Connelly updated on CLG - good position financially; SLIB – Sage Grouse/Sagebrush Initiative; WLCI Board (appointed by Governor) - water projects, irrigation ditches, it’s Oil and Gas money coming back into the area for reclamation. Commissioner Bowers mentioned they are looking into help to haul trees from the storm that hit Smoot, Osmond, and Fairview.
Chairman Connelly reviewed the list of the Road and Bridge projects that are now back logged because of lack of funding. There are millions of dollars in projects with only$700,000 per year in the County
Road fund which is only designated for county roads.

Motion #1: Commissioner Bowers moved to approve the agenda for the day. Seconded by Commissioner Bowers. Motion carried unanimously.
Ken Kuluski, Planning Director, presented the Planning Agenda for the day, the monthly land use permits and the following files:
File 207 MS 22 Good Neighbor Subdivision Third Filing Phase II – Virgina Dorsey with recommendation of approval.
Marlowe Scherbel, applicant’s representative, explained that the project is on the Etna Water System, was approved some time ago, this is now the final plat and borders Etna Village Estates.
Motion #2: Commissioner Shumway moved to approve File 207 MS 22 Good Neighbor Subdivision Third Filing, Phase-II with Findings of Approval A thru C and a Resolution of Approval. Seconded by Commissioner Bowers. Motion carried unanimously.
File 203 MS 26 Crosland 2nd Filing – David & Kristin Crosland with recommendation of approval.
David Crosland, applicant, questioned the need for conditions of approval 1-3 as those are standard in the regulations; he is requesting condition 4 snow storage to be removed as it’s not listed in the county requirements.
Ken Kuluski commented that the snow storage conditions are in the process being added to the regulations.
Marlowe Scherbel commented that this 20% requirement has only been on CUP’s, this is the first time he’s seen this condition on a subdivision. He doesn’t think it’s necessary, it’s already implied that it’s there because of the right of way.
Commissioner Bowers commented that she doesn’t think it’s necessary, so why make it harder for him.
Motion #3: Commissioner Bowers moved to approve File 203 MS 26 Crosland 2nd Filing with Findings of Approval A thru C, Conditions of Approval 1 through 4 with the removal of the 2nd bullet point on Condition 4 reading “Indicate snow storage areas for the private road (20% of road surface)” and a recommendation for the Board of County Commissioners to sign the Development Agreement. Seconded by Commissioner Shumway. Motion carried unanimously.
File 712 MA 26 Etna Ranch Phase IV – Greengate Farm Edna Valley, LLC c/o Earl Darway with recommendation of approval.
Marlowe Scherbel, applicant’s representative, wanted clarification, is there any reason not to strike #8 in the Developer Agreement regarding the plan for Cluster Box Units for postal services. He would like it to be stricken as they cannot get the review by the USPS.
Mikayla Tingey, Surveyor Scherbel, (via video from Afton EOC), commented that the Etna Ranches prior subdivisions were pre-addressed by the Planning Office and that is how they were able to get the approval.
Motion #4: Commissioner Shumway moved to approve File 712 MA 26 Etna Ranch Phase IV with Findings of Approval A thru C, Conditions of Approval 1 thru 5 and recommendation for the Board of County Commissioners to sign the Development Agreement. striking item 8, in Section 2 of the Agreement. Seconded by Commissioner Bowers. Motion carried unanimously.
File 713 MA 26 Etna Ranch Phase V – Greengate Farm Edna Valley, LLC c/o Earl Darway with recommendation of approval.
Motion #5: Commissioner Shumway moved to approve File 713 MA 26 Etna Ranch Phase V with Findings of Approval A thru C, Conditions of Approval 1 thru 5 and a recommendation for the Board of County Commissioners to sign the Development Agreement, striking item 8 in Section 2 of the Agreement. Seconded by Commissioner Bowers. Motion carried unanimously.
File 603 RZ 26 Creamery Park Rezone – Five Crazy Kids, LLC with recommendation of approval.
Marlowe Scherbel, representing applicants, explained the project is for commercial.
Dave Bentlage, applicant, explained their vision is to have smaller lots available for smaller businesses and offer commercial opportunities. They would like young entrepreneurs to have a chance to start in Star Valley. They turned an existing business in the area into a thriving business. Courtney Campbell, applicant, explained that Jackson business owners are getting priced out of rentals and are consistently looking for commercial opportunities in Star Valley, there is a demand for what they’re trying to offer.
Ryan Erickson, Sunrise Engineering, explained they did a Chapter 22 Study on this subdivision, ground water is 120 feet deep (no concern), enhanced systems are fine to meet the requirements. This development has commercial lots with room for living space as well. This was considered and is well within the numbers.
Motion #6: Commissioner Bowers moved to approve File 603 RZ 26 Creamery Park Rezone with Findings of approval A through C and a Resolution of Approval. Seconded by Commissioner Shumway. Motion carried unanimously.
File 708 MA 26 Creamery Park – Five Crazy Kids, LLC with recommendation of approval. Commissioner Shumway asked questions regarding the approach off Hwy 89. Ken Kuluski explained once the southern parcel develops that access would be there. Chairman Connelly questioned the Condition of the USPS review as well on this one.
Ryan Erickson discussed the traffic study for this project. It initially had a south bound right hand turn lane, the study was revised and it was taken out. Marlowe Scherbel commented they have done everything they can, including a cul-de-sac sac turnaround and 60-foot easement for connectivity until WYDOT is willing to grant an approach. Chairman Connelly mentioned Condition 7 regarding the USPS review. Marlowe suggested removing this Condition.
Motion#7: Commissioner Shumway moved to approve File #708 MA 26 Creamery Park with Findings of Approval A thru C, Conditions of Approval 1 through 9, striking Condition #7 (USPS review) and a recommendation to sign the Development Agreement. Seconded by Commissioner Bowers. Motion carried unanimously.
