Kemmerer/Diamondville Joint Powers Board Nations Avenue Transmission Line Replacement
Separate sealed bids for construction for the Kemmerer/Diamondville Joint Powers Board Nations Ave Transmission Line Replacement Project will be received by the Kemmerer/Diamondville Joint Powers Board from bidders.
Bids will be publicly opened and read aloud at 3:00 PM on Tuesday, June 10, 2025 at 1004 Elk St, Kemmerer, WY, 83101.
The work to be performed under this project shall consist of furnishing all labor, materials and equipment required to construct the facilities and features called for by the CONTRACT DOCUMENTS and as shown on the DRAWINGS.
Installation of approximately 1300 LF of 16” Waterline. Disconnection, capping, and abandonment of the existing section of 16” waterline. Connection of the new line to the existing lines, reconnection of service connections, and fire hydrants, installation of valves, one casing, and roadway restoration in the construction area.
This project is funded by the Kemmerer/Diamondville Joint Powers Board and MRG Funds.
Plans and specifications have been prepared by Sunrise Engineering and will be available after Tuesday, May 20, 2025 on their website plan room at http://www.sunrise-eng.com. Click on “Plan Room” at the top of the homepage. Bidders must register and sign-in and choose to become a plan holder to obtain access to CONTRACT DOCUMENTS and DRAWINGS. Notices regarding changes/amendments to the CONTRACT DOCUMENTS and DRAWINGS will be sent to the e-mail address associated with the bidder’s registration. Bidders are responsible to maintain current and correct contact information and check the plan room often to receive updates or additional documents/changes/amendments. The ENGINEER for this Contract will be Sunrise Engineering, Incorporated and they will be represented by Kamilla Schultz, P.E. as Project Engineer.
A pre-bid tour will be held on Tuesday, June 3, 2025, at 3:00 p.m., leaving from the office of the Owner at 1004 Elk Street, Kemmerer, WY, 83101. Attendance at the pre-bid tour is requested. Names of those in attendance will be recorded.
The Contract shall be let to the responsible certified resident making the lowest bid, if the certified resident’s bid is not more than five percent (5%) higher than that of the lowest responsible nonresident bidder and the resident bidder does not propose to subcontract more than thirty percent (30%) of the work to nonresident contractors (Wyo. Stat. 16-6-101, et seq.). Resident for this purpose means a person, partnership, limited partnership, registered limited partnership, registered limited liability company or corporation certified as a resident by the Department of Employment prior to bidding upon the Contract and meeting the further criteria in W.S. 16-6-101, et seq. A resident bidder shall submit a copy of its certificate of residency with its bid.
Pursuant to W.S. 16-6-106, “Preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state.
Bid security in the form of a Bid Bond shall be furnished with the bid in the amount of 5% of the total bid.
Contract security in the form of a Performance Bond and Payment Bond shall be provided pursuant to W.S. 15-1-113(d) and 16-6-112. The contract security shall be 100% of the contract amount pursuant to W.S. 15-1-113 (d) and (f).
Final Payment will not be made until conditions and requirements of W.S. 16-6-116, 16-6-117, and 15-1-113(h) are met.
Retainage will be held on all progress payments in accordance with W.S. 16-6-702. Retainage will be Ten percent (5%) and may be held in a contractor designated interest bearing account for retainage in accordance with W.S. 16-6-702, -704 and -705.

The above sale will be conducted by the Sheriff or the Sheriff’s deputy at the front door of the Lincoln County Courthouse in Kemmerer, Wyoming, at 10:00 a.m. on Tuesday, June 17, 2025.
In the event that either a representative of the Mortgagee or a representative of Wyoming Title and Escrow is not present at the sale, the sale will be postponed until a later date.
Robert Cole Duerr defaulted on the terms of the Note and Mortgage, and as of the date of this Notice, the undersigned claims an outstanding balance of $283,401.73. Interest continues to accrue on the unpaid balance at the rate of $33.49 per day.
The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.

CITY COUNCIL PROCEEDINGS
The Kemmerer City Council met in regular session this 28th day of April, 2025, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor Robert Bowen, Councilmember Marlin Batista, Councilmember David McConkie, Councilmember Brantley Popp, Councilmember Bill Price, and Councilmember Mark Quinn. Councilmember Caleb Ellis was absent.
Motion was made by Councilmember Quinn to excuse the absence of Councilmember Ellis; seconded by Councilmember Popp and unanimously approved by council present.
Motion was made by Councilmember Popp to approve the agenda as amended to delete the Proclamation for Nurses Week; seconded by Councilmember Quinn and unanimously approved by council present.

(c) Motion was made by Councilmember Popp to Pass Approve and Adopt Resolution No. 2025-853, A Resolution Establishing the City of Kemmerer is Committed to Encourage Development Within the City of Kemmerer Which Provides Necessary Housing for the Expected Growth Within the Area Including in Participating in Public/Private Cooperation as Allowed by the Laws of the State of Wyoming; seconded by Councilmember Quinn and unanimously approved by council present.
(d) Motion was made by Councilmember Price to Pass Approve and Adopt Resolution No. 2025-854, Changing the Time for City Council Work Session and Regular Session Meetings; seconded by Councilmember Batista and unanimously approved by council present.
(e) Motion was made by Councilmember Quinn Pass Approve and Adopt Resolution No. 2025-852, Lincoln County Justice Center Expansion Building Permit Fee Reduction Request as amended; seconded by Councilmember Popp and unanimously approved by council present.
(f) Motion was made by Councilmember McConkie to award and authorize the mayor to sign a contract to J.D. Heithoff of Independent Fee Estimates for the Construction Engineering Phase of the Airport Runway Lighting and Wind Cones project in an amount not to exceed $2,370; seconded by Councilmember Quinn and unanimously approved by council present.
(g) Motion was made by Councilmember McConkie to authorize the mayor to Sign the 5- Year Master Service Agreement with J-U-B Engineers for Airport Engineering Services; seconded by Councilmember Popp and unanimously approved by council present.
(h) Motion was made by Councilmember McConkie to authorize the mayor to sign the agreement between the Kemmerer Municipal Airport with the City of Kemmerer as the managing member; and JUB Engineers; in JUB providing General Engineering Services for an amount not to exceed $10,000 for calendar year 2025; seconded by Councilmember Price and unanimously approved by council present.
COMMENTS:
Brian Muir, City Administrator, made comments. Councilmember Price, Councilmember Popp, Councilmember Quinn, Councilmember McConkie, and Councilmember Batista made comments. Mayor Bowen made comments.

This notice is submitted to alert all families of children who attended a Lincoln Uinta Child Development Association developmental disabilities preschool program during the school year 2017 through 2018. If your child received services through one of LUCDA’s centers (Alpine Child Development Center, Bridger Valley Child Development Center, LUCDA-Evanston, Kemmerer Child Development Center, Star Valley Child Development Center (Afton or Thayne) during the years listed, those records will be destroyed on or after June 1, 2025. If parents wish to obtain their child’s records they may contact the local center where their child attended, or the LUCDA Regional Office at P.O. Box 570, Mountain View, WY 82939, (307) 782- 6602 prior to June 1, 2025. Records will be given only to those who can prove guardianship of the child. If you are a friend or relative of a child who attended the program during these years, please assist the program by notifying parents that records are available.
