PUBLIC NOTICE

The Kemmerer City Council will hold a public hearing on Monday, June 9, 2025, at 6 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The purpose of the hearing is to hear public input on the proposed FY 25-26 budget. The public hearing will be followed by a city council meeting to adopt the budget resolution.

Special City Council Meeting Minutes

City of Kemmerer

Thursday, April 24, 2025, 5:00 P.M.,

Kemmerer City Hall

The Kemmerer City Council met in a special session this 24th day of April, 2025. President of the Council, Mark Quinn, called the meeting to order at 5:00 p.m. in the Kemmerer City Hall, 220 Wyoming Highway 233, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor Robert Bowen (via telecon), Councilmember Marlin Batista (via telecon), Councilmember David McConkie, Councilmember Bill Price, and Councilmember Mark Quinn. Councilmember Caleb Ellis and Councilmember Brantley Popp were absent.

Motion was made by Councilmember McConkie to authorize Brian Muir to write a letter authorizing the Lincoln County Sheriff’s Department to land a helicopter at the Lincoln County Justice Center on April 25, 2025, at 1500 hours to conduct a training exercise; seconded by Councilmember Price and unanimously approved by council present.

There being no further business before the Council, President of the Council, Quinn adjourned the meeting; 5:07 p.m.

PUBLIC NOTICE

Lincoln County School District No. 1 will be destroying Special Education Records for students whose records have been maintained for more than 7 years after graduation or enrollment. If you graduated or were last enrolled before July 16, 2018, these records will be destroyed unless students over the age of 18 pick up the records or request in writing that they be maintained. Parents may pick up records if they are the legal guardian or have written permission from the student.

CITY COUNCIL PROCEEDINGS

The Kemmerer City Council met in regular session this 12th day of May, 2025, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor Robert Bowen, Councilmember Marlin Batista, Councilmember Caleb Ellis, Councilmember David McConkie, Councilmember Brantley Popp, Councilmember Bill Price, and Councilmember Mark Quinn.

Motion was made by Councilmember Quinn to approve the agenda as amended to remove the Public Hearing from the agenda, change New Business (a) to Pass, Approve, and Adopt Resolution No. 2025-855, Amending Currently Zoned I2 Section of the Zoning Map to I3, and add New Business (i), Mosquito Grant Application; seconded by Councilmember Popp and unanimously approved by council.

DEPARTMENT REPORTS:

John Tibbetts, Golf and Parks Director; Jamie Thornock, Event and Program Assistant; Lois Hicks, Recreation Coordinator; Mike Kahre, Police Chief; Natasia Diers, City Clerk-Treasurer; and Chad Nielson, Public Works Director, gave department reports to the council.

TABLED BUSINESS:

OLD BUSINESS:

(a) Motion was made by Councilmember Popp to Pass, Approve, and Adopt Ordinance 2025-892, Amending Chapter 16, Refuse, Garbage and Weeds; as amended; seconded by Councilmember Quinn and unanimously approved by council.

(b) Motion was made by Councilmember Quinn to Pass on 2nd Reading, Ordinance No. 2025-895, Zoning Amendment to City of Kemmerer Zoning Map of 20.5 Acres of Land from A-Agriculture to M2-Multi Family Housing on Parcel 2116-233-00-060; seconded by Councilmember Ellis and unanimously approved by council.

(c) Motion was made by Councilmember Price to Pass on 2nd Reading, Ordinance No. 2025-896, Zoning Amendment to City of Kemmerer Zoning Map of 7.9 Acres of Land from Rb- Residential Single Family to M2-Multi Family Housing on Parcel 2116-233-00-0060; seconded by Councilmember Popp and unanimously approved by council.

NEW BUSINESS:

Motion was made by Councilmember McConkie to amend the agenda to move New Business (h) to New Business (a) and renumber remaining business items; seconded by Councilmember Popp and unanimously approved by council.

Doug Hartmann made comments to the council.

(a) Motion was made by Councilmember Batista for the City of Kemmerer to support the outdoor pool and open the pool for the summer of 2025; seconded by Councilmember Price. The mayor then called for the question. Those voting “Yea” were Councilmember Ellis, Councilmember Price, Councilmember Quinn, and Councilmember Batista. Those voting “Nay,” were Councilmember Popp and Councilmember McConkie. Motion carried.

City Administrator, Brian Muir, read a letter from Andrew and Stephanie Kaiser. Warren Ellis, Ty Sellers, Jessica Lozier, and Andrew Kaiser made comments to the council.

(b) Motion was made by Councilmember McConkie to Pass, Approve and Adopt Resolution 2025-855, Correcting the Zoning Map changing the section from I2 to I3 and correcting the legend; seconded by Councilmember Popp. The mayor then called for the question. Those voting “Yea” were Batista, Councilmember McConkie, Councilmember Popp, Councilmember Price and Councilmember Quinn, Councilmember Ellis abstained from the vote. Motion carried.

(c) Motion was made by Councilmember Popp to appoint Brian Muir as the City of Kemmerer’s voting delegate for the 2025 WAM Summer Convention; seconded by Councilmember Price and unanimously approved by council.

(d) Motion was made by Councilmember McConkie to award the Base Bid for the Kemmerer Airport Runway Lighting and Wind Cone Project to Modern Electric of Casper, Wyoming in the amount not to exceed $728,500.00; seconded by Councilmember Quinn and unanimously approved by council.

(e) Motion was made by Councilmember McConkie to authorize Mayor Bowen to sign the Construction Engineering Contract with J-U-B Engineering for the EMM Rwy 16-34 construction engineering phase of the Runway Lighting and Wind Cone Project at the Kemmerer Airport in an amount not to exceed $141,700; seconded by Councilmember Popp and unanimously approved by council.

(f) Motion was made by Councilmember Ellis to authorize the mayor to sign the WYDOT FY 2025 Salt and Sand Project Agreement in an amount not to exceed $21,729; seconded by Councilmember Popp and unanimously approved by council.

(g) Motion was made by Councilmember Batista to accept the litigation settlement offer with the UMWA with the clarification that the City will need to have completed W-9 forms for all parties named in the settlement offer; seconded by Councilmember McConkie and unanimously approved by council.

(h) Motion was made by Councilmember McConkie to authorize staff to enlist the services of MC2 for the purpose of applying for the Safe Streets for All grant in an amount not to exceed $4,000; seconded by Councilmember Quinn and unanimously approved by council.

(i) Motion was made by Councilmember McConkie to authorize staff to apply for the 2025 mosquito spraying grant; seconded by Councilmember Quinn and unanimously approved by council.

COMMENTS:

Councilmember Popp and Councilmember Price made comments. City Administrator, Brian Muir, made comments. Mayor Bowen made comments.

There being no further business before the Council, Mayor Bowen adjourned the meeting; 10:40 p.m.

ADVERTISEMENT FOR BIDS

Kemmerer/Diamondville Joint Powers Board Nations Avenue Transmission Line Replacement

Separate sealed bids for construction for the Kemmerer/Diamondville Joint Powers Board Nations Ave Transmission Line Replacement Project will be received by the Kemmerer/Diamondville Joint Powers Board from bidders.

Bids will be publicly opened and read aloud at 3:00 PM on Tuesday, June 10, 2025 at 1004 Elk St, Kemmerer, WY, 83101.

The work to be performed under this project shall consist of furnishing all labor, materials and equipment required to construct the facilities and features called for by the CONTRACT DOCUMENTS and as shown on the DRAWINGS.

Installation of approximately 1300 LF of 16” Waterline.  Disconnection, capping, and abandonment of the existing section of 16” waterline.  Connection of the new line to the existing lines, reconnection of service connections, and fire hydrants, installation of valves, one casing, and roadway restoration in the construction area. 

This project is funded by the Kemmerer/Diamondville Joint Powers Board and MRG Funds.

Plans and specifications have been prepared by Sunrise Engineering and will be available after Tuesday, May 20, 2025 on their website plan room at http://www.sunrise-eng.com. Click on “Plan Room” at the top of the homepage. Bidders must register and sign-in and choose to become a plan holder to obtain access to CONTRACT DOCUMENTS and DRAWINGS. Notices regarding changes/amendments to the CONTRACT DOCUMENTS and DRAWINGS will be sent to the e-mail address associated with the bidder’s registration. Bidders are responsible to maintain current and correct contact information and check the plan room often to receive updates or additional documents/changes/amendments. The ENGINEER for this Contract will be Sunrise Engineering, Incorporated and they will be represented by Kamilla Schultz, P.E. as Project Engineer.

A pre-bid tour will be held on Tuesday, June 3, 2025, at 3:00 p.m., leaving from the office of the Owner at 1004 Elk Street, Kemmerer, WY, 83101. Attendance at the pre-bid tour is requested. Names of those in attendance will be recorded.

The Contract shall be let to the responsible certified resident making the lowest bid, if the certified resident’s bid is not more than five percent (5%) higher than that of the lowest responsible nonresident bidder and the resident bidder does not propose to subcontract more than thirty percent (30%) of the work to nonresident contractors (Wyo. Stat. 16-6-101, et seq.). Resident for this purpose means a person, partnership, limited partnership, registered limited partnership, registered limited liability company or corporation certified as a resident by the Department of Employment prior to bidding upon the Contract and meeting the further criteria in W.S. 16-6-101, et seq. A resident bidder shall submit a copy of its certificate of residency with its bid.

Pursuant to W.S. 16-6-106, “Preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state.

Bid security in the form of a Bid Bond shall be furnished with the bid in the amount of 5% of the total bid.

Contract security in the form of a Performance Bond and Payment Bond shall be provided pursuant to W.S. 15-1-113(d) and 16-6-112. The contract security shall be 100% of the contract amount pursuant to W.S. 15-1-113 (d) and (f).

Final Payment will not be made until conditions and requirements of W.S. 16-6-116, 16-6-117, and 15-1-113(h) are met.

Retainage will be held on all progress payments in accordance with W.S. 16-6-702. Retainage will be Ten percent (5%) and may be held in a contractor designated interest bearing account for retainage in accordance with W.S. 16-6-702, -704 and -705.

Each BIDDER will be required to submit, with his proposal, a certified check, or Bid Bond made payable without condition to the Town of LaBarge in the amount of not less than five percent (5%) of the BIDDER's maximum Bid Price as guarantee that such BIDDER will enter into a contract within fifteen (15) days after the date of the OWNER's Notice of Award.

The above sale will be conducted by the Sheriff or the Sheriff’s deputy at the front door of the Lincoln County Courthouse in Kemmerer, Wyoming, at 10:00 a.m. on Tuesday, June 17, 2025.

In the event that either a representative of the Mortgagee or a representative of Wyoming Title and Escrow is not present at the sale, the sale will be postponed until a later date.

Robert Cole Duerr defaulted on the terms of the Note and Mortgage, and as of the date of this Notice, the undersigned claims an outstanding balance of $283,401.73. Interest continues to accrue on the unpaid balance at the rate of $33.49 per day.

The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.
