Meeting recessed for lunch at 11:24 am.  Regular session resumed at 1:00 pm.

Chairman Connelly opened the public hearing for the Lincoln Star ISD at 1:00 pm.  He read an email that was received at 8:00 am from Brad Barham, TriSight, explaining that due to unforeseen circumstances he and Boston Barham, Blazon Development Corporation, two of the three landowners in the proposed ISD are unable to attend and asked for the hearing to be postponed.  Chairman Connelly continued with the public hearing and opened it up to public comment.  Mary Crosby, County Grants Writer, commented that there’s been struggle in Lincoln County in getting smaller industrial development and support services.  The reason behind the interest of these 3 landowners in forming an Improvement and Service District was to help with services.  The statutes allow a lot of flexibility.  She is not aware of any other developments at this time as was put out on Facebook.  The purpose of the hearing is to allow the public and landowners to comment and for the Commissioners to decide whether the property owners affected, who would be paying for it, could be benefited by the formation of the district.

Dawn Marquardt, LaBarge resident, is opposed to them approving the Lincoln Star ISD as proposed today.  She commented this is being framed as economic development, but the public has heard promises tied to the same footprint for years, TriSight specifically.  TriSight received county opportunity through the land deal and are tied up in active federal litigation.  She questioned why the County would consider new public financing in infrastructure to acreage tied to a stalled private project still sitting in federal litigation.  She explained that an ISD is not just a routine special district.  It creates a political subdivision with real authority, assessments and financing tools.  The proposal is not one clean connected area; the parcels are miles apart.  She would like to know what public purpose ties these parcels together.  The perception is that Lincoln County is stacking one public funding mechanism on top of another to make a private project viable after it has failed to raise money on its own.  She also questioned Criterium’s role, what the $500,000 county loan tied to the Lincoln Star ISD was for; what were the deliverables and has any of the money been paid back.  TriSight, Evaunt, Brad Barham, Ed Ektrom, county land, county money and now Lincoln Star ISD all tie together; if every induvial piece has an explanation, the public deserves an explanation.  She also questioned how the county sewer package plant ties to the ISD proposal, if it will service TriSight and the Canyon Road Holdings commercial property, which public entity will pay for and operate it, which private property will benefit and how does it connect to the Lincoln Star ISD.  Her concerns are whether the County is creating a public governmental structure around selected private interests, overlapping players and projects that haven’t proven viable on their own.  Before it moves forward, she is asking for answers of who benefits, who pays, what the public risks, what county money has already gone into it, what infrastructure is actually planned, has Criterium repaid the $500,000, where does the package plant fit in and why create a new political subdivision around this collection of properties.  This looks like another attempt to make TriSight and related private development viable through public mechanisms.  The public deserves answers before approval.

Robert Chapin, Opal landowner in petition, commented he was approached about doing land development in Opal and the purpose of the ISD was for bringing in infrastructure; water, sewer, natural gas that would also benefit the Town of Opal.  Criterium isn’t part of the ISD as far as he knows.

Jamie Thornock asked if the TriSight land is going to be part of an AI plant/data center.  The Commissioners had no knowledge of this.

Chairman Connelly closed the public hearing closed at 1:10 pm.

Austin Dunlap, Deputy County Attorney, commented that the Commissioners’ decision is not contingent upon whether the landowners are there or not.  Commissioner Shumway does question how it’s an improvement with the three properties so far apart.  Commissioner Bowers had the same thoughts.

Motion #9: Commissioner Shumway moved to approve the Lincoln Star ISD petition.  Motion failed due to lack of second.

Motion #10: Commissioner Bowers moved to continue the public hearing to a later date.  Seconded by Commissioner Shumway with discussion from Chairman Connelly regarding the timeframe for the continuation.  Motion carried unanimously.  The hearing is postponed until the June 16, 2026, Commission meeting.

Mike Hunsaker commented he was there to testify on the importance of the creation of this EMS District and explained there is a substantial amount of misinformation regarding the Commissioners’ Resolution to create the district.  He encourages the Commissioners to vote yes to create the district, it’s the first step of supporting the emergency medical services in North Lincoln County and is an opportunity for the Commissioners to appoint a board to review options.  Then, if the board determines to ask for a mill levy, the voters have the opportunity to determine their own fate in supporting a mill levy.  He explained that ten years ago there were only 3 EMS services in North Lincoln County.  It was a struggle to staff ambulance services and there were times that he and the CEO of the hospital volunteered to drive the ambulance.  He explained that Star Valley Health entered into an agreement 5 years ago with the towns of Thayne, Alpine and Star Valley Ranch to assume responsibility to operate an ambulance service.  It’s very expensive to operate and man it 24 /7 and provide the type of service the public demands.  Star Valley Health operates it at a loss of 2.5 million per year.  He asked that they please vote yes on the resolution to create an EMS District, create the board and then let the voters determine the fate of the mill levy.  Commissioner Shumway commented that they have received 22 letters;13 opposed to the district and 9 in support.  Chairman Connelly commented that is very slim input.  He has heartburn with the Commissioners appointing the board and he is used to having petitions presented.  Eric Greene, Alpine Mayor (via video Afton EOC), commented he has served on the Alpine Fire District Board and has history and knowledge of the EMS services going from volunteer to the hospital district.  He is on the EMS working group and is confident this is the best option to move forward with this district.  He understands there hasn’t been much feedback, but would assume if people are given the option, they would prefer to call 911 to have someone show up and would be willing to pay.  They would be falling short to base it only on 22 letters and encourages them to take the next step and develop the district and put it on the ballot and let the voters decide on a mill levy.  Trevor Merritt, Vice President of HR and Support Services at Star Valley Heath (via video Afton EOC), commented he is on the working group for EMS and echoed what has been said by Mike Hunsaker and Mayor Greene.  He asked to let this go through the process and commented If everyone understood the challenges, the answers would be much clearer.  He explained there are lower call volumes than a typical urban area so they can’t generate as much revenue but have to staff it for the potential.  It’s important to understand the challenges of little revenue and having to staff it.  He asked that they give the people an opportunity to be heard in the November election whether or not it’s funded.  Phil Jorgensen, former Alpine EMS Director (via video Afton EOC), saw firsthand volunteer services were not running correctly.  He explained it’s important to understand that EMS will go away if this district isn’t passed.  He doesn’t want to see it go down the drain because there wasn’t a lot of feedback and the community needs to understand this district would help a lot of people.  Commissioner Shumway thanked Star Valley Health for helping the last 5 years and understands there is a need to address the overhaul of the EMS District.  He is not sure this is the direction; it may be unfair for the Commissioners to set the board without public input that would set the mill levy.  He is concerned with having a district that is unfunded and ineffective if the voters don’t pass a mill levy.  He thinks it’s best to get it back into the people’s hands to get board members voted in by the people.  Commissioner Bowers commented that is her opinion as well.  Chairman Connelly commented this is happening at a time when the 50% property tax cut proposition will be on the ballot, if a district mill levy passed and the 50% cut passed, they would only get 2 mills.  He believes the people should be setting the board, this takes away the right of the people and districts are formed by the people.  He’s been in emergency services himself and there are very few people who don’t think this will fail in the long run and commented the South Lincoln Hospital chose not to participate.

Commissioner Shumway moved to approve the Resolution to Establish the North Lincoln Emergency Medical Services.  Seconded by Commissioner Bowesrs.  Motion failed 2-1.  Commissioner Bowers voted in favor.  Commissioner Shumway and Chairman Connelly voted against it.
