CITY COUNCIL PROCEEDINGS
The Kemmerer City Council met in regular session this 12th day of October, 2020, at 7:00 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor Anthony Tomassi, Councilman Robert Bowen, Councilman Bill Price, Councilman Mark Quinn, Councilman John Sawaya, Councilman Eric Rudy and Councilman Bill Thek.
Motion was made by Councilman Sawaya to approve the agenda of October 12, 2020, as amended adding a Public Hearing after the Approval of Agenda and new business item (c) Issue a New Bar and Grill Liquor License to Matthew W. Wright, dba, Kettle, seconded by Councilman Rudy and unanimously approved by Council.

(a) Motion was made by Councilman Thek to authorize the Mayor to sign the Easement Lease Agreement with Faulkner Nicholas Trust (Antler Motel) to access the snow dump in an amount not to exceed $936.00 for a two-year lease agreement; seconded by Councilman Rudy and unanimously approved by Council.
(b) Motion was mad by Councilman Thek to award the bid for the two 2020 Flat Gray Dump Boxes and Hydraulic Systems to Kois Brothers of Commerce CO in the amount not to exceed $114,528.00; seconded by Councilman Bowen and unanimously approved by Council.
(c) Motion was made by Councilman Sawaya to issue a new Bar and Grill Liquor License to Matthew W. Wright, dba, Kettle at 307 US Highway 189; seconded by Councilman Price and unanimously approved by Council.
COMMENTS:
City Administrator, Brian Muir, made comments. Councilman Thek, Councilman Quinn, and Councilman Bowen made comments. Mayor Tomassi made comments.
Councilman Bowen made the motion to recess into executive session concerning property acquisition; seconded by Councilman Thek and unanimously approved by Council at 7:34 p.m.
Councilman Sawaya made the motion to reconvene into regular session; seconded by Councilman Price and unanimously approved by Council.
There being no further business before Council, Councilman Rudy made a motion to adjourn the meeting; seconded by Councilman Quinn and unanimously approved by Council; 8:14 p.m.

In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Enterprise Products to modify the Pioneer Dew Point Depression Plant by increasing the facility throughput to 600 MMscfd, increasing throughput at the two (2) hot oil heaters, changing the existing emergency flare to a process flare, changing the annual hours of operation of the two (2) Caterpillar G3412C LE emergency generator engines from 500 to 100 hours, changing the existing eight (8) 450 barrel (bbl) produced water tanks to condensate tanks, revising throughput of the condensate truck loadout, adding an existing 300 bbl produced water tanks and updating the existing fugitive components. The Pioneer Dew Point Depression Plant is located in NW¼ SE¼ of Section 22, T21N, R114W, approximately one (1) mile north northwest of Opal, in Lincoln County, Wyoming.

ADVERTISEMENT FOR BIDS
NOTICE IS HEREBY GIVEN that the Town of Diamondville, Wyoming will receive sealed bids for replacing old interior & exterior light fixtures in the Diamondville Town Hall, Town Shop, Car Wash and Pavilion with new high efficiency LED fixtures. The bid will consist of labor only for the installation of the supplied fixtures. A facility walk will be hosted on November 16, 2020 at 9:00 a.m. The facility walk will begin at Diamondville Town Hall at 20 US Hwy. 30/189 in Diamondville. A general job description will be available at that time for interested bidders; please call 307-877-6676 with questions.
Interested bidders are required to conduct an independent on-site survey to ensure understanding of the scope of work and conditions in which the work will occur. Each bid must be broken out per location for labor costs and include a total bid price of all locations. Labor bids are to include all miscellaneous materials, all permits if applicable, as well as any lift charges. Additionally, each bidder must clearly state it understands that all work will comply with all local, state, federal and any applicable codes, be licensed, insured, and bonded.
Each bid must be delivered to the Diamondville Town Clerk at the Diamondville Town Hall located at (mailing P.O. Box 281) (physical 20 US HWY 30/189), Diamondville, WY 83116 on or before the 30th of November 2020 by 5:00 p.m. All bids will be opened at the 7th of December at the hour of 6:00p.m. by the governing body of the Town of Diamondville at the regular meeting of the council. The successful bidder, if any, shall be announced by the Town at such time as the Governing Body of the Town may determine appropriate, but no later than (30) days from the date of the bid opening. The Town reserves the right to waive any informality or minor irregularity in any bid. The Town reserves the right to reject any or all bids submitted if it is determined that none of them would serve the public interest. If a contract is awarded, it will be awarded to the bidder whose recommended equipment and scope of work meet all technical and illumination and code requirements and is, in the sole discretion of the Governing Body of the Town, the best contractor and equipment for use by the Town at the lowest bid price. Such factors as options, warranties, maintenance and repair statistics, and product and design function, in addition to bid price, shall be considered by the Town in awarding this bid.
Each bid must be submitted in compliance with Wyoming Statute Section 15-1-113 to be considered. Each bid submitted must be accompanied by a bid bond, or by a certified check, money order or cashier’s check, in the amount not less than the 5% of the total amount of the bid, sufficient surety and payable to the Town. The bid bond, certified check, money order or cashier’s check of the successful bidder shall be forfeited to the Town as liquidated damages if the successful bidder fails to enter into the contract with the Town within 30 days following presentation of the contract, or fails to make delivery of the bid property within the time specified for delivery, and/or fails to make delivery of the bid property within the time specified for delivery, and/or fails to fully comply with any other contractual agreements with the Town relating to this bid.
Each bid must be delivered in a sealed envelope clearly marked Town Hall, Town Shop, Car Wash and Pavilion lighting upgrade. In accordance with the Wyoming Statute Section 16-6-101 through 16-6-107, preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured or grown in Wyoming or supplied by a resident of the State, quality being equal to articles offered by the competitors outside of the state.
