The Kemmerer City Council met in regular session this 28th day of May, 2019, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The Pledge of Allegiance was recited.

Present on roll call were Mayor Anthony Tomassi, Councilman Robert Bowen, Councilman David Crosland, Councilman Dave McGinnis, Councilman Mark Quinn, and Councilman Eric Rudy.  Councilman Vance Chamberlain was absent.

Motion was made by Councilman Quinn to excuse the absence of Councilman Chamberlain; seconded by Councilman Bowen.  The Mayor then called for the question.  Those voting “Yea” – Councilman Bowen, Councilman Crosland and Councilman Quinn.  Those voting “Nay” – Mayor Tomassi, Councilman McGinnis and Councilman Rudy.  Motion failed.

Motion was made by Councilman Crosland to approve the agenda for May 28, 2019, as presented; seconded by Councilman Quinn and unanimously approved by Council present.

Motion was made by Councilman Bowen to remove from the table Resolution No. 2019-764; seconded by Councilman Quinn and unanimously approved by Council present.

Motion was made by Councilman Bowen to support Resolution 2019-764, A Resolution Supporting the Authority of Cities and Towns to Create Taxing Districts, with the amendment of changing the last paragraph of the resolution to read:

“NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF KEMMERER, WYOMING, HEREBY RESOLVES to request that the State of Wyoming empower municipalities, alone and/or in partnership with other local governments, to raise revenues to fund projects necessary to meet the needs of local residents and visitors by allowing voters within the municipal limits and/or the combined political boundaries of the cooperating governmental bodies to enact a special purpose excise tax, commonly known as a 6th Penny tax, to use for those purposes allowed by W.S. 39-15-203;”

Seconded by Councilman Quinn and unanimously approved by Council present.

OLD BUSINESS:

(a) Motion was made by Councilman Quinn to award the proposal for 3 years of auditing services to Jones Simkins, LLC; seconded by Councilman Rudy and unanimously approved by Council present.

(b) Motion was made by Councilman Crosland to support WAM Resolution No. 19-13 and WAM Resolution No. 19-14; seconded by Councilman Rudy and unanimously approved by Council present.

COMMENTS:

Brian Muir made comments.  Councilman Quinn, Councilman Crosland, and Councilman McGinnis made comments.  Mayor Tomassi made comments.

Motion was made by Councilman Rudy to recess the regular meeting and go into executive session to discuss personnel, land and litigation; seconded by Councilman Bowen and unanimously approved by council present, 7:45 p.m.

Motion was made by Councilman Bowen to move into executive session; seconded by Councilman Crosland and unanimously approved by council present.  7:52 p.m.

Motion was made by Councilman Crosland to adjourn executive session; seconded by Councilman Rudy and unanimously approved by council present.  8:38 p.m.

Motion was made by Councilman McGinnis to reconvene into the regular meeting; seconded by Councilman Rudy and unanimously approved by council present.  8:40 p.m.

There being no further business before the council, motion was made by Councilman Quinn to adjourn the regular meeting; seconded by Councilman McGinnis and unanimously approved by Council present, 8:41 p.m.

Lincoln County School District No. 1 will be destroying Special Education Records for students whose records have been maintained for more than 7 years after graduation or enrollment. If you graduated or were last enrolled before July 16, 2012, these records will be destroyed unless students over the age of 18 pick up the records or request in writing that they be maintained. Parents may pick up records if they are the legal guardian or have written permission from the student.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Regulations, notice is hereby given of the Application of Questar Gas Company d/b/a Dominion Energy Wyoming (Dominion Energy or the Company), for approval of its plan to refund deferred income taxes to its customers to account for the Tax Cuts and Jobs Act of 2017.

Dominion Energy is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(D), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112. 

On May 2, 2019, Dominion Energy filed its Application requesting Commission accept and approve the Company’s proposal to return the benefits of excess tax reserve (EDIT) to its Wyoming customers in the next fall pass-on and that the amortization amount and period of the Other Non-Plant related EDIT be determined in the next general rate case. The Company has determined that the Wyoming allocation of EDIT balance at the end of 2017 was $7,567,333.

This is not a complete description of the Application.  Interested persons may inspect the Application at the Commission’s offices in Cheyenne, Wyoming during regular business hours.

Anyone desiring to file a public comment, statement, intervention petition, protest or request for a public hearing in this matter must do file with the Commission in writing on or before June 27, 2019. Any intervention request filed with the Commission shall set forth the grounds of the proposed intervention or request for hearing as well as the position and the interest of the petitioner in this proceeding.

The Wyoming Public Service Commission seeks comments from interested persons regarding the implementation of SF 0159 (SEA 074).

The Sixty-Fifth Wyoming Legislature authorized “AN ACT relating to public utilities; limiting the recovery of costs for the retirement of coal fired electric generation facilities; proving a process for the sale of an otherwise retiring coal fired electric generation facility; exempting a person purchasing an otherwise retiring coal fired electric generation facility from regulation as a public utility; requiring purchase of electricity generated from purchased retiring coal fired electric generation facility as specified; and providing for an effective date.

This new law takes effect July 1, 2019.  It requires the Commission to make various decision related to the retirement of coal-fired power plants owned by public utilities.  The Commission seeks comments to ensure its proceedings under the new law are effective and efficient and that decisions related to the retirement of coal-fired power plants are consistent with the public interest.
