CITY COUNCIL PROCEEDINGS

The Kemmerer City Council met in regular session this 13th day of May, 2019, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The Pledge of Allegiance was recited.

Present on roll call were Mayor Anthony Tomassi, Councilman Robert Bowen, Councilman Vance Chamberlain, Councilman David Crosland and Councilman Dave McGinnis.  Councilman Mark Quinn and Councilman Eric Rudy were absent.

Motion was made by Councilman Bowen to excuse the absence of Councilman Quinn and Councilman Rudy; seconded by Councilman Chamberlain.  The Mayor then called for the question.  Those voting “Yea” – Councilman Bowen and Councilman Chamberlain.  Those voting “Nay” – Mayor Tomassi, Councilman Crosland and Councilman McGinnis.  Motion failed.

Motion was made by Councilman Crosland to unexcuse the absence of Councilman Quinn and Councilman Rudy; seconded by Councilman McGinnis.  The Mayor then called for the question.  Those voting “Yea” – Mayor Tomassi, Councilman Crosland and Councilman McGinnis.  Those voting “Nay” – Councilman Bowen and Councilman Chamberlain.  Motion carried.

Motion was made by Councilman Crosland to approve the agenda for May 13, 2019, as presented; seconded by Councilman Bowen and unanimously approved by Council present.

(c) Motion was made by Councilman McGinnis to authorize the payment of invoice 846 to Bugman, Inc. in the amount of $250.00 (check #13050); seconded by Councilman Bowen and unanimously approved by Council present.

Vance Chamberlain rejoined the meeting: 7:17 p.m.

(d) Motion was made by Councilman Bowen to authorize the mayor to sign the Arbor Day Proclamation for celebration on May 14, 2019; seconded by Councilman McGinnis and unanimously approved by Council present.

(e) Motion was made by Councilman Chamberlain to authorize the mayor to sign a 5 year lease for a new copier at the Recreation Center; seconded by Councilman Crosland and unanimously approved by Council present.

(f) Motion was made by Councilman Bowen to authorize the mayor to sign the updated agreement for the Gravel Pit with BLM; seconded by Councilman Chamberlain and unanimously approved by Council present.

(g) Motion was made by Councilman Crosland to sign the agreement with Lincoln County for FY19-20 landfill fees; seconded by Councilman Bowen and unanimously approved by Council present.

(h) Motion was made by Councilman Crosland to appoint Dean Stout as the temporary prosecuting attorney for the City of Kemmerer; seconded by Councilman Bowen and unanimously approved by Council present.

(i) Motion was made by Councilman Crosland to select Dave McGinnis as the voting delegate at the 2019 WAM Summer Convention; seconded by Councilman Chamberlain.  Councilman Crosland then amended his motion to select Dave McGinnis as the voting delegate and Brian Muir as the alternate voting delegate at the 2019 WAM Summer Convention; seconded by Councilman Chamberlain and unanimously approved by Council present.

(j) Motion was made by Councilman Crosland to support WAM Resolution No. 19-09; seconded by Councilman Bowen and unanimously approved by Council present.

Motion was made by Councilman McGinnis to support WAM Resolution No. 19-10; no second was made.  Motion died.

Motion was made by Councilman McGinnis to support WAM Resolution No. 19-11; seconded by Councilman Bowen. The Mayor then called for the question. Those voting “Yea” – Mayor Tomassi, Councilman Bowen, and Councilman McGinnis. Those voting “Nay” – Councilman Crosland and Councilman Chamberlain. Motion passed.

Motion was made by Councilman Bowen to not support WAM Resolution No. 19-12; seconded by Councilman Chamberlain and unanimously approved by Council present.

(k) Motion was made by Councilman Crosland to table the authorization for the Mayor to submit Resolution 2019-764, A Resolution Supporting the Authority of Wyoming Cities and Towns to Create Taxing Districts, to WAM; seconded by Councilman Bowen and unanimously approved by Council present

INVITATION TO BID

Separate sealed bids for construction of Kemmerer-Diamondville Joint Powers Board Emerald Street Waterline Replacement will be received by Kemmerer-Diamondville Water and Wastewater Joint Powers Board from bidders.

Bids will be publicly opened and read aloud at  11:00 AM on  June 6, 2019 at  The KDJPB Office, 220 Highway 233, Kemmerer, Wyoming      .

The work to be performed under this project shall consist of furnishing all labor, materials and equipment required to construct the facilities and features called for by the CONTRACT DOCUMENTS and as shown on the DRAWINGS. 

KDJPB Emerald Street Waterline Replacement Project, as detailed in the Drawings and Specifications. Project generally consists of the replacement of 800 feet of 12” diameter steel pipe using trenchless methods

This project is funded by Wyoming State Land & Investment Board, KDJPB.

Plans and specifications have been prepared by Sunrise Engineering, Inc. and will be available after May 16, 2019 on their website plan room at http://www.sunrise-eng.com. Click on “Plan Room” at the top of the homepage. Bidders must register and sign-in and choose to become a plan holder to obtain access to CONTRACT DOCUMENTS and DRAWINGS. Notices regarding changes/amendments to the CONTRACT DOCUMENTS and DRAWINGS will be sent to the e-mail address associated with the bidder’s registration. Bidders are responsible to maintain current and correct contact information and check the planroom often to receive updates or additional documents/changes/amendments. The ENGINEER for this Contract will be Sunrise Engineering, Incorporated and they will be represented by Ryan J. Erickson, P.E. as Project Engineer.

The Contract shall be let to the responsible certified resident making the lowest bid, if the certified resident’s bid is not more than five percent (5%) higher than that of the lowest responsible nonresident bidder and the resident bidder does not propose to subcontract more than thirty percent (30%) of the work to nonresident contractors (Wyo. Stat. 16-6-101, et seq.).  Resident for this purpose means a person, partnership, limited partnership, registered limited partnership, registered limited liability company or corporation certified as a resident by the Department of Employment prior to bidding upon the Contract and meeting the further criteria in W.S. 16-6-101, et seq.  A resident bidder shall submit a copy of its certificate of residency with its bid.

Pursuant to W.S. 16-6-106, “Preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state.”

Bid security in the form of a Bid Bond shall be furnished with the bid in the amount of 5% of the total bid.

Contract security in the form a Performance Bond and Payment bond shall be provided pursuant to W.S. 15-1-113(d) and 16-6-112.  The contract security shall be 100% of the contract amount pursuant to W.S. 15-1-113 (d) and (f).

Final Payment will not be made until conditions and requirements of W.S. 16-6-116, 16-6-117, and 15-1-113(h) are met.

Retainage will be held on all progress payments in accordance with W.S. 16-6-702.  Retainage will be Ten percent (10%) and may be held in a contractor designated interest bearing account for retainage in accordance with W.S. 16-6-702, -704 and -705.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, notice is hereby given of Rocky Mountain Power’s (RMP or the Company) Application to decrease rates under Tariff Schedule 197, 2017 Federal Tax Cut Adjustment.

RMP is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

On or about December 22, 2017, federal tax legislation was enacted titled “An Act to Provide Reconciliation Pursuant to Titles II and IV of the Concurrent Resolution of the Budget for Fiscal Year 2018” (Tax Cuts and Jobs Act or TCJA). On May 16, 2018, the Company submitted an application proposing to return the benefits of the TCJA. Specifically, RMP requested Commission approval of [i] proposed Tariff Schedule 197 to authorize the Company to reduce currents rates addressing the benefits from the TCJA; and [ii] approve the Stipulation entered into between RMP and Wyoming Industrial Energy Consumers. The Company proposed rate credits that reduce Wyoming customer retail rates by approximately $26.1 million (3.8%). RMP stated the total reduction included an annual credit allocation of $22.5 million in Tariff Schedule 197 to all retail tariff customers using the class cost of service from RMP’s most recent general rate case (Sub 469) as well as an additional allocation of $3.6 million to offset the recent 2018 ECAM docket. By its Memorandum Opinion, Findings and Order Approving Stipulation issued on March 15, 2019, in Sub 469, the Commission approved the part of the Stipulation in which the parties agreed to refund $22.5 million of the tax benefits to customers until the next general rate case using the average-of-period rate base calculations and rejected the part of the Stipulation in which parties agreed to use some of the benefits to automatically offset future costs related to the ECAM and Energy Vision 2020 projects.

On April 17, 2019, RMP filed its Application requesting to decrease rates under Tariff Schedule 197, 2017 Federal Tax Cut Adjustment. Specifically, RMP requests to decrease rates by $0.04 million (or 0.05 percent) to deliver additional benefits from the TCJA. RMP states the $22.5 million refund continues to be reflected in the Schedule 197 rates by the Company is replacing the $3.6 million to offset the 2018 Energy Cost Adjustment Mechanism (ECAM) with rates to refund to customers $3.96 million. The $3.96 million refund will partly offset the costs the Company seek to recover in the 2019 ECAM application which requested a total increase to customer rates of approximately $9.97 million. The Company calculated its proposed rate credits from Schedule 197 using the rate base allocation from the class cost of service study included in Sub 469.

RMP is requesting an effective date of June 15, 2019 for the proposed rates under Tariff Schedule 197. If approved, the proposed rates will result in an overall customer rate reduction of approximately $0.4 million.
