Notice is hereby given that the State Transportation Commission of Wyoming has accepted as completed according to plans, specifications and rules governing the same work performed under that certain contract between the State of Wyoming, acting through said Commission, and Kilroy, LLC, The Contractor, on Highway Project Number 1206008 in Lincoln County, consisting of grading, draining, placing crushed base and bituminous pavement surfacing, full depth reclamation, chip seal, bridge replacements and miscellaneous work, and the Contractor is entitled to final settlement therefore; that the Director of the Department of Transportation will cause said Contractor to be paid the full amount due him under said contract on June 13, 2022.

The date of the first publication of this Notice is May 3, 2022.

INVITATION FOR BID

Sealed proposals will be received for the Rehabilitate Wildlife Fencing project, addressed to the Kemmerer City Hall, Kemmerer Municipal Airport, 220 State Hwy 233, Kemmerer, WY 83101 until 4:30 pm local time on Tuesday, May 24, 2022, and then will  be publicly opened and read. Bids received after the time fixed for the opening will not be considered.

A pre-bid meeting will be held online at 11:00 am, local time Thursday, May 12, 2022 for those interested contractors, subcontractors, and suppliers. The project consists of, but is not limited to, the removal of portions of existing 8-ft wildlife fencing on wood posts, installation of new, 8-ft tall wildlife (wildlife) fencing with wood posts, and relocation of two chain link vehicle swing gates.

The City of Kemmerer in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

This project includes State funds and is subject to the wage provisions of the Wyoming State Public Works Laws.

Each bidder shall furnish the Statement of Bidders Pre-Qualifications to the OWNER with satisfactory evidence of their competency to perform the work contemplated with the bid.

The City of Kemmerer reserves the right to reject any and all proposals, waive any informalities, or irregularities, postpone the award of the Contract for a period not to exceed Forty-five (45) days, and accept the proposal that is in the best interest of the City of Kemmerer. The award of the Bid is contingent upon the receipt of Federal funding.

ORDINANCE NO. 2022-869

AN ORDINANCE AMENDING SECTION 23-59, WATER/SEWER REQUIREMENTS AND SECTION 18-8, REQUIRED FOR OCCUPIED LAND WITHIN TWO HUNDRED FEET OF PUBLIC SEWER; EXCEPTION.

BE IT ORDAINED by the Governing Body of the City of Kemmerer, Lincoln County, Wyoming, that section 23-59 and section 18-8 of the Kemmerer City Code is hereby amended as follows:

SECTION 23-59.  WATER/SEWER REQUIReMENTS

Lots greater than two (2) acres and further than 400 feet from a sewer main may use individual sewage disposal systems.

SECTION 188.  REQUIRED FOR OCCUPIED LAND WITHIN FOUR HUNDRED FEET OF PUBLIC SEWER; EXCEPTIONS.

(a)       All occupied lots or parts of lots or land in the city within four hundred feet (400’) or less of the public sewer of the city shall be connected by private drain connections with the public sewer, in the manner as provided in this chapter, and no privy vault or cesspool shall be maintained, kept or continued thereon.

LEGAL NOTICE

PROPOSED HAZARDOUS WASTE PERMIT MODIFICATION AND PUBLIC NOTICE OF PROPOSED REMEDY AGREEMENT UNDER THE VOLUNTARY REMEDIATION PROGRAM

Pursuant to Wyoming Statute § 35-11-1604, FMC Corporation (FMC) is giving notice that FMC and the Wyoming Department of Environmental Quality (WDEQ) are proposing to enter into a Remedy Agreement (RA) under the Voluntary Remediation Program (VRP) for the Former Kemmerer Coke Plant, located at 1733 Elkol Road, Kemmerer, Wyoming (hereinafter referred to as “Site”). Pursuant to WDEQ/Hazardous Waste Rules and Regulations Chapter 1 Section 124(c) and Section 270 [40 CFR Section 270.42(c)(1)], FMC has prepared a Hazardous Waste Permit Modification Request to incorporate the proposed RA and other necessary updates into the Hazardous Waste Permit. The proposed updates to the permit include:  Waste Analysis Plan, Groundwater Protection Standard, Corrective Action Schedule, Hazardous Waste Unit Landfill Maintenance Plan, Sampling Analysis Plans for the Groundwater Compliance Program and Corrective Action, and the Monitoring Well Installation, Maintenance and Closure Plan.  WDEQ is giving notice and soliciting comments from the public regarding the RA and Permit Modification Request. 

The Former Coke Plant ceased operation on April 30, 2001, and was demolished and all above-grade production equipment and plant structures removed from the property by October 2002.  Currently FMC is conducting post-closure care for the Hazardous Waste Management Unit Landfill and facility-wide corrective action under the existing Hazardous Waste Management Facility Permit No. WYD069811404 (WDEQ Hazardous Waste Site #40.010) issued by the WDEQ on December 6, 2005, and renewed and became effective on March 11, 2016. 

The VRP was established to provide a safe and efficient method for cleaning up contaminated sites and putting them back into productive use.  On June 13, 2003, WDEQ accepted the Former Kemmerer Coke Plant into the VRP.  Under the VRP, FMC and WDEQ entered into a Preliminary Remediation Agreement on April 27, 2005 in order to facilitate site characterization, human health and ecological risk assessment, and evaluation and selection of a remedy.  As described in the RA, WDEQ and FMC propose to excavate contaminated soil and remedy the groundwater contamination with monitored natural attenuation.  In accordance with W.S. 35-11-1607, the requirements and remediation standards set forth in a RA are permanent, except for certain situations where the agreement may be reopened or terminated.

In accordance with the provisions of the Wyoming Environmental Quality Act and Hazardous Waste Rules and Regulations Chapter 1, Section 124(c) and Section 270 [40 CFR Section 270.42(c)(1)], the WDEQ also proposes to modify the Hazardous Waste Management Facility Permit (Permit) for the Former Kemmerer Coke Plant.  The WDEQ determined that modification of the Permit is necessary to incorporate the proposed remedy described in the RA, as well as the proposed updates to the Permit as described above. 

The 60-day public comment period for the RA and Permit Modification Request begins May 10, 2022, and ends July 14, 2022.  The permittee’s compliance history (i.e. Administrative Record) during the life of the permit being modified is available from the Agency contact person. The RA and Permit Modification Request are also available for inspection and copying at the WDEQ offices located at 510 Meadowview Drive, Lander, Wyoming, and 122 West 25th Street, Herschler Building-4W, Cheyenne, WY, or at the Lincoln County Library, 519 Emerald Street, Kemmerer, WY. 

WDEQ and FMC welcome and request comments to the RA and Permit Modification Request.  Written comments must be received by WDEQ no later than 5:00 p.m. on July 14, 2022 and must be sent to:
