Sealed bids for the purchase of a new TRAILER JETTER for the Kemmerer-Diamondville Water & Wastewater Joint Powers Board will be received at the Office of the Board, 224 Wyoming Highway 233, PO Box 1020, Kemmerer, WY  83101, until 2pm local time, Thursday, March 5, 2020, at which time and place said bids will be publicly opened and read aloud.

If at the time the bid is to be awarded, the owner determines that the amount of funds available is enough to finance the project, the bid may be awarded to the lowest responsible bidder.  Determination for the lowest responsible bidder shall consider all applicable provisions of WY Statute 1977, as amended.

The bid shall be let to the responsible certified resident bidder (as defined by WY Statutes) making the lowest bid if the certified residents bid is not more the five percent (5%) higher than that of the lowest responsible non-resident bidder.

The Joint Powers Board reserves the right to reject any and all bids, to waive any informality in bids and to accept any bid or bids deemed to be in the best interest of the Joint Powers Board.  Bids must be original, signed, sealed bids on our form.  Faxed bids will not be accepted.  Bids may not be withdrawn after the time fixed for opening.

PUBLIC NOTICE

The Wyoming Public Service Commission (Commission) approved the Application of Rocky Mountain Power (RMP or the Company) for authority to revise its tariff schedules 70 and 72 to increase the Blue Sky block size from 100 to 200 kilowatt hours (kWh), effective on and after January 1, 2020. The proposed revision responds to growing customer demand for renewable energy and aligns the Company’s tariffs with current market conditions. The Commission’s approval is subject to notice, protest, intervention, refund, change, further investigation, opportunity for hearing and further order of the Commission.

On November 7, 2019, RMP submitted its Application requesting authority to revise tariff Schedules 70 and 72 to increase the Blue Sky Block value from 100 to 200 kWh. Participation in the Blue Sky program is optional for Wyoming customers who want to offset their energy usage requirements with renewable energy by purchasing blocks of bundled renewable energy certificates (RECs). Tariff 70 and 72 define RECs and the types of renewable energy sources underlying the RECs. Customers purchase RECs to ensure they are renewable energy users. The Company then retires those purchased RECs on the customer’s behalf and maintains Green-E certification of the Blue Sky program. Currently, the Company’s tariff defines “Blocks” as 100 kWh of renewable energy. The Company requests the Block value increase to 200 kWh of renewable energy. Customers will continue to have the right to purchase as many Blocks as they would like.

This is not a complete description of RMP’s Application. The Application is on file with the Commission at its offices in Cheyenne, Wyoming, and at RMP’s Wyoming business offices. The Application is available for inspection by any interested person during regular business hours or online at: http://psc.state.wy.us/.

Separate sealed bids for construction of Kemmerer-Diamondville Joint Powers Board Emerald Street Waterline Replacement Project 2020 will be received by Kemmerer-Diamondville Water and Wastewater Joint Powers Board from bidders.

The work to be performed under this project shall consist of furnishing all labor, materials and equipment required to construct the facilities and features called for by the CONTRACT DOCUMENTS and as shown on the DRAWINGS.

KDJPB Emerald Street Waterline Replacement Project, as detailed in the Drawings and Specifications. Project generally consists of the replacement of 800 feet of 12” diameter pipe. Alternates for asphalt repair including milling and replacement of full road width or trench repair only.

This project is funded by Wyoming State Land & Investment Board, KDJPB, City of Kemmerer.

Plans and specifications have been prepared by Sunrise Engineering, Inc. and will be available after February 20, 2020 on their website plan room at http://www.sunrise-eng.com.Click on “Plan Room” at the top of the homepage. Bidders must register and sign-in and choose to become a plan holder to obtain access to CONTRACT DOCUMENTS and DRAWINGS. Notices regarding changes/amendments to the CONTRACT DOCUMENTS and DRAWINGS will be sent to the e-mail address associated with the bidder’s registration. Bidders are responsible to maintain current and correct contact information and check the planroom often to receive updates or additional documents/changes/amendments. The ENGINEER for this Contract will be Sunrise Engineering, Incorporated and they will be represented by Ryan J. Erickson, P.E. as Project Engineer.

A pre-bid tour will be held on  March 10 ,2020, at 11 a.m., leaving from the office of the Owner at 220 Highway 233, Kemmerer, Wyoming,  Attendance at the pre-bid tour is requested. Names of those in attendance will be recorded.

The Contract shall be let to the responsible certified resident making the lowest bid, if the certified resident’s bid is not more than five percent (5%) higher than that of the lowest responsible nonresident bidder and the resident bidder does not propose to subcontract more than thirty percent (30%) of the work to nonresident contractors (Wyo. Stat. 16-6-101, et seq.). Resident for this purpose means a person, partnership, limited partnership, registered limited partnership, registered limited liability company or corporation certified as a resident by the Department of Employment prior to bidding upon the Contract and meeting the further criteria in W.S. 16-6-101, et seq. A resident bidder shall submit a copy of its certificate of residency with its bid.

Pursuant to W.S. 16-6-106, “Preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state.”

Bid security in the form of a Bid Bond shall be furnished with the bid in the amount of 5% of the total bid. Contract security in the form a Performance Bond and Payment bond shall be provided pursuant to W.S. 15-1-113(d) and 16- 6-112. The contract security shall be 100% of the contract amount pursuant to W.S. 15-1-113 (d) and (t).

Final Payment will not be made until conditions and requirements ofW.S. 16-6-116, 16-6-117, and 15-1-113(h) are met.

Retainage will be held on all progress payments in accordance with W.S. 16-6-702. Retainage will be Ten percent (10%) and may be held in a contractor designated interest bearing account for retainage in accordance with W.S. 16- 6-702, -704 and -705.

ORDINANCE NO. 2020-862

AN ORDINANCE AMENDING SECTION 15-43 OF THE KEMMERER CITY CODE – DISCHARGING OF WEAPONS AND SECTION 15-44 WEAPONS; POSSESION OR PROHIBITED USE PF DANGEROUS WEAPON

Be it ordained that the following sections of the Kemmerer City Codes are hereby amended to read as follows:

SECTION 15-43 WEAPONS – DISCHARGING OF FIREARMS

  1. a) It shall be unlawful for any person other than a duly authorized law enforcement officer acting within the scope and course of his or her official duty, to willfully and intentionally or negligently discharge any firearm within or into the city limits or while on city property. For the purpose of this section the word “firearm” shall include, but shall not be limited to, any cannon, gun, pistol, revolver, pellet gun, B-B gun, slingshot or weapon of any description from which a bullet or other projectile is expelled by spring release, gunpowder explosion or air compression, or any bow and arrow, or crossbow and arrow.
  2. b) Excepting that the following shall not be construed as being in violation of paragraph (a) of this section;

1) firearm discharge at a place, specifically designed or designated and approved in writing by the Chief of Police as an indoor weapons firing range, after demonstrating a safe place and method of confining any projectile(s) to that specific property; or

2) bow and arrow discharge at a place specifically designed or designated and approved in writing by  the Chief of Police as an outdoor archery range or bow-hunting area, after demonstrating a safe place and method of confining any projectile(s) to that specific property; or

3) firearm discharge during sanctioned events or displays or activities at a specific location that have the prior written authorization of the Chief of Police, upon determining that such authorization will: not be detrimental to the health, safety, and welfare of city residents or visitors; or

4) other needful firearm discharge with written permission of the Chief of Police and subject to conditions imposed by him or her such as date, occasion, place and times allowed.

Permission to discharge under this paragraph (b) shall be subject to revocation at any time by the Chief of Police. Denial of a request to discharge under this subsection shall be appealable to the governing body.

SECTION 15-44 WEAPONS – POSSESSION OR PROHIBITED USE OF DANGEROUS WEAPON.

  1. a) It shall be unlawful for any person to have in his or her possession, except within his or her own commercial establishment, any firearm, loaded or unloaded, knife with a blade exceeding five inches (5”) in length, dangerous weapon or explosive or incendiary device in any establishment licensed to dispense alcoholic beverages.
  2. b) Nothing in this section shall prevent the possession of any said dangerous weapons by:

1) A law enforcement officer in the lawful discharge of his or her duties.

2) The owner, lessee, tenant or operator of the licensed premises or their agents, including privately employed security personnel during the performance of their duties.

3) A person in that area of the licensed premises usually and primarily rented on a daily or short-term basis for sleeping or residential occupancy, including hotel or motel rooms; or

4) A person on that area of a licensed premises primarily utilized for vehicular traffic or parking.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for a Certificate of Public Convenience and Necessity (CPCN) to expand the Blacks Fork Substation, as more fully described below:

RMP is a public utility, as defined in Wyo. Stat. §37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. §37-2-112

On February 10, 2020, the Company submitted an Application together with exhibits requesting the Commission grant a CPCN to expand the Blacks Fork Substation.

Specifically, RMP requests the Commission grant a CPCN to expand the Blacks Fork substation. The expansion would include: one new transformer to step down voltage from 230 kilovolt (kV) to 34.5 kV; three new 230 kV circuit breakers arranged in a ring bus configuration; one new 230 kV feeder bay with a breaker for future connection, one new feeder bay and two new 34.5 kV circuit breakers; one new primary meter; and a differential protection scheme to allow feeders to operate parallel if necessary.

The expansion of the substation and related facilities as general system improvements, has an estimated total cost of $10.5 million.

The Company intends to finance the Project through its normal internal and external sources of capital, including net cash flow from operating activities, public and private debt offerings, the issuance of commercial paper, the use of unsecured revolving credit facilities, capital contributions, and other sources. The financial impact will not impair the Company’s ability to continue to provide safe and reliable electricity service at reasonable rates. The Company is not requesting ratemaking treatment at this time.

According to RMP, the proposed expansion is required to provide adequate reliability in response to the request from an existing large industrial customer for a load increase.

This is not a complete description of RMP’s Application. Interested persons may inspect the entire Application at RMP’s Wyoming offices and at the Commission’s offices in Cheyenne, Wyoming, during regular business hours. The Application may also be reviewed on line at http://www.pacificorp.com.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding the Application of Rocky Mountain Power (RMP or the Company) for approval of the 2020 Inter-Jurisdictional Cost Allocation Agreement. The Wyoming Office of Consumer Advocate and the Wyoming Industrial Energy Consumers have intervened in this matter. The public hearing is set to commence on Monday, March 9, 2020, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.

RMP is a division of PacifiCorp, an Oregon corporation, which provides electric service to retail customers through its RMP division in the states of Wyoming, Utah and Idaho through its Pacific Power division in the states of Oregon, California and Washington. RMP is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

On December 3, 2019, RMP submitted its Application, together with supporting testimony and exhibits, requesting approval of its 2020 Protocol. RMP states that PacifiCorp owns substantial generation and transmission facilities. Augmented with wholesale power purchases and long-term transmission contracts, these facilities operate as a single system on an integrated basis to provide service to customers in a cost-effective manner.  PacifiCorp recovers the costs of owning and operating its generation and transmission system in retail prices established from time to time in state regulatory proceedings.

Since all of RMP’s generation and transmission resources and other common or general functions are considered to be used to service RMP’s customers in all of its state jurisdictions, it is necessary to determine what portion of these costs should be allocated to customers in the state for which prices are being established. RMP states if different state commissions make different decision regarding what resources should be included in PacifiCorp’s rates, or if different state commissions adopt different policies for allocating the costs of resources among states, RMP may not be afforded an opportunity to recover its full cost of providing electric service. 

After approximately three years of discussions and negotiations, the interested parties reached an agreement that led to the 2020 Protocol agreement being present in this docket.   The 2020 Protocol will allocate costs among RMP’s multi-state service territory and ensure that the Company operates its generation and transmission system on an integrated basis to achieve a least-cost, least-risk resource portfolio, while allowing each state to pursue, independently, its ratemaking policies.

All interested persons are encouraged to attend the public hearing which will be conducted in accordance with the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission Rules and Special Regulations. Sealed BIDS for a general contract for the City of Kemmerer – 2020 Lincoln Heights Drive Re-Surfacing Project consisting of approximately the following items:

Milling and overlay of approximately 3,370 square yards of existing asphalt street surfacing.  The milling shall be to a depth of 2” and the surface shall then be overlaid with 3” thick hot plant mix bituminous pavement on Lincoln Heights Drive between Elk Street and 3rd West Avenue.  Manholes and valve boxes within the re-surfaced area shall be adjusted to the new surface and have concrete collars replaced.

FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated October 23, 2018, executed and delivered by Brandon Simpson and Sammi Simpson (“Mortgagors”) to The Federal Savings Bank, and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by said Mortgagors, to Mortgage Electronic Registration Systems, Inc. as nominee for The Federal Savings Bank, its successors and assigns as Mortgagee, and which Mortgage was recorded on October 29, 2018, at Reception No. 1000716, in Book 936, at Page 412 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Lincoln County, State of Wyoming; and

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of January 27, 2020 being the total sum of $325,074.81, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;
