Notice is hereby given that The City of Kemmerer is holding a public hearing at a Special Meeting of the City Council on Tuesday, October 4th, 2022, at 6:00 p.m. at the Kemmerer City Hall, 220 State Hwy 233, Kemmerer, Wyoming, regarding the possible purchase and sale of the following city-owned properties in Kemmerer Wyoming:  a parcel with a building and lot at 821 South Main Street, estimated appraised value $21,000; a parcel made up of three adjacent 3,500 square foot lots on 809 and 823 Main Street, estimated appraised value $60,000; a parcel made up of 5 lots totaling 14,350 square feet along 823 Pine Ave (Highway 189), estimated appraised value $85,000.  It is anticipated that a new businesses at these locations will provide new jobs and revenues for the Kemmerer economy and add to the Kemmerer and Lincoln County tax base.

CITY COUNCIL MEETING MINUTES

September 12, 2022

The Kemmerer City Council met in regular session this 12th day of September, 2022, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor William Thek, Councilmember Robert Bowen, Councilmember Dale Hicks, Councilmember Bill Price, Councilmember Mark Quinn, Councilmember Eric Rudy and Councilmember Jamie Thornock.

Motion was made by Councilmember Quinn to approve the agenda as presented; seconded by Councilmember Rudy and unanimously approved by Council.

VISITORS’ COMMENTS:

Eddie Ourada made comments to the council.  Brian Tresp made comments to the council.

Motion was made by Councilmember Hicks to approve the items on the consent agenda as amended; seconded by Councilmember Bowen and unanimously approved by Council. Those items were:

(c) authorize the Mayor to sign the agreement with DBT Transportation Services for NAVAID and AWOS support and maintenance at the airport for a 3-year term from October 1, 2022 – September 30, 2025.

NEW BUSINESS:

(a) Motion was made by Councilmember Hicks to grant a 50% fee waiver to the Holiday Magic Boutique for the November 5, 2022, craft fair; seconded by Councilmember Quinn and unanimously approved by Council.

(b) Motion was made by Councilmember Price to approve the replat of the Thompson Second Addition; seconded by Councilmember Hicks and unanimously approved by Council.

(c) Motion was made by Councilmember Hicks to approve vacating the lot line between lots 1 and 2 of Block 55 of the Second Addition to the Town of Kemmerer (Archer Addition); seconded by Councilmember Rudy and unanimously approved by Council.

Council recessed the meeting; 7:38 p.m.

Council reconvened the meeting; 7:46 p.m.

(d) Motion was made by Councilmember Quinn to approve the 1st Reading of the proposed zoning amendment to the Commercial District; seconded by Councilmember Hicks and unanimously approved by Council.

COMMENTS:

City Administrator, Brian Muir, made comments.  Councilmember Quinn, Councilmember Hicks, Councilmember Price, and Councilmember Bowen made comments.  Mayor Thek made comments.

There being no further business before the Council, Councilmember Hicks made a motion to adjourn the meeting; seconded by Councilmember Quinn and unanimously approved by Council; 8:06 p.m.

ADVERTISEMENT FOR BIDS

NOTICE IS HEREBY GIVEN that the Town of Diamondville, Wyoming will receive sealed bids for the turnkey installation of a Splash Pad at the Diamondville Park.  Interested bidders are required to conduct an independent on-site survey to ensure understanding of the scope of work and conditions in which the work will occur.  Please call 307-877-6676 to arrange the date and time.

Each bid must be delivered to the Diamondville Town Clerk at the Diamondville Town Hall located at 20 US Highway 30-189, Diamondville, WY by October 14, 2022.  Each bid must be delivered in a sealed envelope clearly marked Diamondville Park Splash Pad.  In accordance with the Wyoming Statute 16-6-101 through 16-6-107, preference is hereby given to materials, supplies, agricultural products, equipment, machinery, and provisions produced, manufactured, or grown in Wyoming or supplied by a resident of the State, quality being equal to articles offered by the competitor outside of the state.

All bids will be opened at the 17th of October Regular Council Meeting by the governing body of the Town of Diamondville at the hour of 6:00 p.m.  The successful bidder, if any, shall be announced by the Town at such time as the Governing Body of the Town may determine appropriate, but no later than (30) days from the date of the bid opening.  The Town reserves the right to waive any informality or minor irregularity in any bid.  The Town reserves the right to reject any or all bids submitted if it is determined that none of them would serve the public interest.   If a contract is awarded, it will be awarded to the bidder whose recommended equipment and scope of work meet all technical and code requirements and is in the sole discretion of the Governing Body of the Town, the best contractor and equipment for use by the Town, such factors as options, warranties, maintenance and repair statistics, and product and design function, in addition to bid price shall be considered by the Town in awarding this bid.

Each bid must be submitted in compliance with Wyoming Statute Section 15-1-113 to be considered.  Each bid submitted must be submitted by a bid bond, or by a certified check, money order or cashier’s check in the amount not less than 5% of the total amount of the bid, sufficient surety and payable to the Town.  The bid bond, certified check, money order or cashier’s check of the successful bidder shall be forfeited to the Town as liquidated damages if the successful bidder fails to enter into the contract with the Town within 30 days following presentation of the contract, or fails to make delivery of the bid property within the time specified for delivery, and/or fails to fully comply with any other contractual agreements with the Town relating to this bid.

NOTICE OF FINAL ACCEPTANCE

To all persons, corporations or firms who have any claim for work done for or any materials furnished to Phil Viviano dba Viviano’s Concrete for the South Lincoln Special Cemetery District’s, “2022 Diamondville Cemetery, Storage Building Access Driveway” located in Diamondville, Wyoming.

You are hereby notified that the South Lincoln Special Cemetery District has accepted as completed, according to plans and specifications and rules set forth in the Agreement between the Cemetery District and the aforementioned Contractor, the work in connection with the 2022 Diamondville Cemetery, Storage Building Access Driveway, and that said Contractor is entitled to final settlement.

You are further notified that upon November 6, 2022 being the 41st day after the first publication of this Notice, the South Lincoln Special Cemetery District will pay to Phil Viviano — dba Viviano’s Concrete the full amount due under said Contract, and in the event that your claim is not filed with said District prior to said November 6, 2022, the same shall be waived.

This notice is given pursuant to Section 16-6-116 Wyoming Statutes.
