ORDINANCE NO. 2022-872
AN ORDINANCE AMENDING ARTICLE IV OF CHAPTER 5, KEEPING OF CHICKENS.
BE IT ORDAINED by the Governing Body of the City of Kemmerer, Lincoln County, Wyoming, that Article IV of the Kemmerer City Code is hereby amended as follows:
SECTION 5-32. NUMBER, TYPE AND LOCATION.
The maximum number of chickens allowed is twelve (12) per premise.
Only female chickens are allowed. There is no restriction on species. Roosters are not permitted on the premises at any time.
Chickens shall only be permitted in the A B Agriculture, R - Residential Zone, RE Residential Estate Zone and Ra Single Family Residential zone.
SECTION 5-33. ENCLOSURES.
(b) If chickens are not allowed to roam within an enclosed area outside the coop, the coop shall have a minimum floor area of six (6) square feet per chicken.
(1) The coop shall be located in a rear yard at least fifteen (15) feet from any property line shared with an adjacent non-government owner.
(d) Henhouses/Coop
(1) (B) REPEALED 7-25-22
(e) Chicken Runs.
(1) An enclosed chicken run must be provided consisting of sturdy wire fencing. The pen must be covered with wire, aviary netting, or solid roofing. The enclosure shall have a minimum area of square feet per chicken but not to exceed 225 square feet.
SECTION 5-37. PERMIT REQUIRED; FEES.
(a) A permit to keep chickens shall be issued by the City Administrator or designee. The permit will require a physical inspection of the property to ensure the chicken coop and run conforms to the standards of Section 5-33 Enclosures and provides adequate food storage and waste removal.
(b) REPEALED 7-25-22

FORECLOSURE SALE NOTICE
WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated November 24, 2020, executed and delivered by Cassandra Dee Jones (“Mortgagor”) to The Federal Savings Bank, and a real estate Mortgage (the “Mortgage”) of the same date securing the Note, which Mortgage was executed and delivered by Cassandra Dee Jones and Randall L. Jones to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for The Federal Savings Bank, its successors and assigns as Mortgagee, and which Mortgage was recorded on December 7, 2020, at Reception No. 1013995, in Book 1002, at Page 398 in the public records in the office of the County Clerk and ex-officio Register of Deeds in and for Lincoln County, State of Wyoming; and
WHEREAS, the Mortgage was assigned for value as follows:

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and
WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage as of July 13, 2022 being the total sum of $138,736.15, plus interest, costs expended, late charges, and attorneys’ fees accruing thereafter through the date of sale;
WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid;

Lot 3 of Block 6 of the Lincoln Heights 4th Subdivision of the Town of Kemmerer, Lincoln County, Wyoming, as per plat recorded October 3, 1977, as Plat No. 499086 of the records of the Lincoln County Clerk.
With an address of 1331 Coulson Ave, Kemmerer, WY 83101 (the undersigned disclaims liability for any error in the address).
Together with all improvements thereon situate and all fixtures and appurtenances thereto.
Mortgagee shall have the exclusive right to rescind the foreclosure sale during the redemption period.  In the event that the sale is rescinded or vacated for any reason, the successful purchaser shall only be entitled to a refund of their purchase price and/or statutory interest rate.
